A venti giorni dalla scadenza, il traguardo è sempre più vicino. Hanno superato quota 300mila in venti giorni le firme a sostegno dell’iniziativa popolare per il referendum sulla riforma Nordio, disponibile dal 22 dicembre sul sito del ministero della Giustizia (qui per firmare con Spid o Carta d’identità elettronica). L’obiettivo delle 500mila sottoscrizioni è ormai completo al 62%: per raccoglierle c’è tempo fino al 30 gennaio, quando scadranno i tre mesi dalla pubblicazione della legge costituzionale in Gazzetta ufficiale.
Secondo la prassi seguita finora, il governo non potrebbe fissare la data del voto prima di quella scadenza, proprio per permettere ai promotori dell’iniziativa, un gruppo di 15 giuristi capitanati dall’avvocato Carlo Guglielmi, di completare la raccolta e accedere alla campagna referendaria come soggetto costituzionalmente tutelato. La premier Giorgia Meloni, però, ha confermato che l’intenzione è quella di deliberare già nel prossimo Consiglio dei ministri, convocando le urne per domenica 22 e lunedì 23 marzo (l’indizione formale spetterà poi al presidente della Repubblica). Per farlo, la maggioranza vuol sfruttare la richiesta di referendum già depositata dai parlamentari e ammessa dall’Ufficio centrale presso la Corte di Cassazione. I promotori, però, hanno già annunciato ricorso al Tar se il governo andrà dritto per la sua strada: come ha spiegato al Fatto il loro avvocato, il testo del quesito depositato dai giuristi “è diverso da quello che è già stato ammesso”, perciò ci sarebbe spazio perchè la Cassazione, in caso di successo della raccolta firme, decida di modificarlo.

Twenty days from the deadline, the goal is closer than ever. In twenty days, over 300,000 signatures have been gathered in support of the popular initiative for the referendum on the Nordio reform, available since December 22nd on the Ministry of Justice website (here to sign with Spid or electronic identity card). The target of 500,000 subscriptions is now complete at 62%; there is time to collect them until January 30th, when the three months from the publication of the constitutional law in the Official Gazette expire.
According to the practice followed so far, the government could not set the date of the vote before that deadline, in order to allow the promoters of the initiative, a group of 15 lawyers led by lawyer Carlo Guglielmi, to complete the collection and access the referendum campaign as a legally protected subject. However, Prime Minister Giorgia Meloni has confirmed that the intention is to deliberate already at the next Council of Ministers, calling for the polls for Sunday, March 22nd and Monday, March 23rd (the formal announcement will then be up to the President of the Republic). To do so, the majority wants to take advantage of the referendum request already filed by parliamentarians and admitted by the Central Office at the Court of Cassation. However, the promoters have already announced an appeal to the TAR if the government goes ahead as planned: as explained to Il Fatto Quotidiano by their lawyer, the text of the question submitted by the lawyers “is different from the one that has already been admitted,” therefore there would be room for the Cassation to decide to modify it in case of a successful collection of signatures.
