Il Fatto Quotidiano: “Riforma della giustizia? Tecnicamente è un disastro, l’Alta corte non potrà destituire i magistrati”: l’analisi del procuratore di Bari

“La riforma è scritta male, tecnicamente è un disastro“. Lo ha detto il procuratore capo di Bari, Roberto Rossi, intervistato nel corso di una diretta YouTube dal direttore de ilFattoQuotidiano.it e condirettore de il Fatto Quotidiano, Peter Gomez, e dal giornalista Paolo Frosina. Il riferimento è al “pasticcio” (parola adoperata da Rossi) per cui, stando alla riforma costituzionale voluta da Carlo Nordio e dal governo Meloni, l’Alta Corte, cioè l’organo aggiuntivo previsto dalla legge, non potrà né sospendere né trasferire i magistrati.
Un “buco” normativo a cui lo stesso Rossi non sa dare nessuna spiegazione, se non che “la riforma è scritta male, in fretta, gli emendamenti sono stati tutti bocciati. Si sono dimenticati di affrontare questo punto. E al momento non c’è modo di correggere” la svista. “L’altro problema è quello dell’impugnazione. Il cittadino può ricorrere in Cassazione. Con questa revisione costituzionale il magistrato avrebbe invece una tutela minore, perché potrà ricorrere solamente – viene usato proprio questo avverbio – alla Corte accanto, cioè allo stesso organo”.

“The reform is badly written, technically it’s a disaster.” That’s what Bari’s chief prosecutor, Roberto Rossi, said in an interview conducted during a YouTube live broadcast with the director of ilFattoQuotidiano.it and deputy editor of il Fatto Quotidiano, Peter Gomez, and journalist Paolo Frosina. The reference is to the “muddle” (the word used by Rossi) for which, according to the constitutional reform proposed by Carlo Nordio and the Meloni government, the Supreme Court, that is, the supplementary body provided for in the law, will not be able to suspend or transfer judges.

A “regulatory gap” that Rossi himself doesn’t know how to explain, except that “the reform is written badly, hastily, all the amendments were rejected. They forgot to address this point. And at the moment there’s no way to correct” the oversight. “The other problem is that of appeal. The citizen can appeal to the Court of Cassation. With this constitutional revision, the judge would instead have less protection, because he would only be able to appeal – this very adverb is being used – to the adjacent court, that is, the same body.”

Ha rinunciato alla prescrizione ed è stato assolto nel merito l’amministratore giudiziario Salvatore Ziccardi, arrestato nel 2016 con le accuse di turbativa d’asta e induzione indebita a dare o promettere utilità. Si chiude così una vicenda giudiziaria durata dieci anni. Ziccardi fu arrestato dai Carabinieri su richiesta della Procura di Santa Maria Capua Vetere: un imprenditore dei rifiuti aveva dichiarato che il professionista si era fatto promettere una mazzetta in cambio di una notizia riservata su una procedura di gara. La somma non era stata mai versata.
Ziccardi era stato assolto già in primo grado. Ora è caduta anche l’ipotesi di turbativa d’asta, per la quale la Cassazione aveva annullato con rinvio una precedente condanna: al termine del secondo processo, la Corte d’Appello ha stabilito che il fatto non sussiste. “Non abbiamo mai avuto dubbi sull’innocenza di Ziccardi. Resta il rammarico per una vita distrutta per dieci anni”, dichiarano i suoi avvocati, Domenico Ciruzzi e Marco Campora.

Il Tempo: La7 in sciopero contro Cairo, la protesta dei giornalisti della rete tv

Quello del giornalista è un lavoro difficile, e non solo per la complessità del mestiere. Ma anche perché la stampa - tv e cartacea - non è un settore che se la passa benissimo, tra nuovi media e social network che ne erodono progressivamente gli spazi, anche economici. L'ultima protesta è quella dei giornalisti di La7, che hanno ufficializzato uno sciopero, le cui date sono ancora sconosciute. Oggetto della rivendicazione sarebbero le retribuzioni per le domeniche lavorative e quelle dei nuovi assunti dall'emittente. Secondo quanto riportato dai giornalisti, l'editore Urbano Cairo, nell'ultimo incontro con il Comitato di Redazione, non avrebbe dato seguito all'ultimo pronunciamento della Corte di Cassazione proprio sulle retribuzioni domenicali e sulla applicazione del Contratto collettivo nazionale e degli accordi integrativi aziendali per i neo assunti.
L'Assemblea dei giornalisti ha spiegato le proprie ragioni in un comunicato. «I giornalisti de La7 - si legge nella nota - scioperano per l'atteggiamento sconcertante dell'editore che, nell'ultimo incontro con il Comitato di Redazione, ha ribadito di non voler rispettare il pronunciamento definitivo della Corte Costituzionale sulla corretta retribuzione delle domeniche».
Ancora, spiegano i giornalisti, «si ostina a non voler riconoscere ai colleghi assunti negli ultimi anni la corretta applicazione del contratto collettivo nazionale e degli accordi integrativi aziendali». Alla luce di tutto ciò, il Comitato di redazione conclude il comunicato avvertendo che «tali diritti e i colleghi con contratti depotenziati saranno tutelati in sede legale». Insomma, quello che si prospetta all'orizzonte rischia di essere uno sciopero ben più lungo di qualche ora.
