AGI - Si deve tornare in aula per stabilire se è scattata per Raffaele Ventura la prescrizione del reato di omicidio del poliziotto Antonio Custra e se, quindi, Ventura, che vive in Francia dal 1981, può tornare in Italia da uomo libero. Lo ha deciso la Cassazione che ha annullato con rinvio la decisione con la quale la Corte d'Assise d'Appello di Milano aveva confermato un'ordinanza del 2024 che sanciva la 'fine' del reato per il trascorrere del tempo per l'ex militante delle Formazioni Comuniste Combattenti.
La Suprema Corte ha accolto il ricorso della procuratrice generale di Milano Francesca Nanni sancendo che le sei ore trascorse da Ventura negli uffici della polizia francese il 17 luglio 2017, sulla base di un mandato di arresto europeo, valsero a interrompere la prescrizione della pena e a revocarne l'estinzione dichiarata dai giudici d'appello. Ventura, oggi 77enne, era riparato in Francia negli anni della 'dottrina Mitterand' che garantiva l'ospitalità a chi avesse lasciato la lotta armata. Era stato condannato per concorso morale a 14 anni di carcere nel delitto Custra avvenuto il 14 maggio 1977 in via De Amicis a Milano.
Il nuovo giudizio sulla prescrizione
Se nel nuovo giudizio i giudici milanesi dovessero stabilire che la prescrizione non si è compiuta, l'orologio della prescrizione ripartirà dal 2017. "Il ricorso deve essere accolto in quanto la motivazione resa dalla Corte di assise di appello di Milano non ha approfondito in modo adeguato il tema costituito dalla temporanea privazione della libertà personale per alcune ore di Raffaele Ventura - si legge nelle motivazioni della Cassazione - onde verificare se essa abbia integrato un caso di arresto provvisorio all'estero idoneo a costituire inizio della procedura di esecuzione della pena". Ventura erano uno dei dieci terroristi che sarebbero dovuti tornare in Italia per scontare le pene dopo un accordo tra Francia e Italia nel 2021 poi bocciato dai giudici francesi.

The Court of Cassation has ordered a return to court to determine whether Raffaele Ventura’s charge of the murder of police officer Antonio Custra has been prescribed and, consequently, whether Ventura, who has lived in France since 1981, can return to Italy as a free man. The Court of Cassation annulled with remand the decision with which the Court of Appeal of Milan had confirmed an order of 2024 that declared the ‘end’ of the crime due to the passage of time for the former member of the Combat Communist Formations.
The Supreme Court accepted the appeal of the Milan Public Prosecutor’s Office, Francesca Nanni, stating that the six hours Ventura spent in French police offices on July 17, 2017, based on a European arrest warrant, served to interrupt the prescription of the penalty and revoke the extinction of punishment declared by the appellate judges. Ventura, now 77 years old, was sheltered in France during the ‘Mitterand doctrine’ which guaranteed hospitality to those who had left armed struggle. He was sentenced to 14 years in prison for aiding and abetting in the Custra murder, which occurred on May 14, 1977, on Via De Amicis in Milan.
New Judgment on Prescription
If in the new judgment the Milan judges determine that the prescription has not occurred, the prescription clock will restart from 2017. “The appeal must be granted as the motivation given by the Court of Appeal of Milan did not adequately examine the issue of temporary deprivation of personal liberty for a few hours of Raffaele Ventura - it reads in the Cassation’s rationale - in order to verify whether it constituted a case of provisional arrest abroad suitable to constitute the beginning of the execution of the penalty.” Ventura was one of the ten terrorists who were due to return to Italy to serve their sentences after an agreement between France and Italy in 2021, which was then rejected by the French judges.
