Il Tempo: "Dal governo arroganza del potere”, Gratteri alza ancora il tiro. Nordio lo inchioda

"Questo referendum è importante, la parola chiave del mio approccio per contrastare la riforma è stata l'arroganza: io non sopporto gli arroganti nella mia vita". E' quanto ha detto il procuratore capo di Napoli, Nicola Gratteri, durante il suo intervento sul palco del teatro Diana, a Napoli, durante l'iniziativa sul referendum 'Giusto dire No'. "C'è un pacchetto che il Governo blinda, va in Parlamento dove non cambia una virgola. Dico io, almeno fate una finta. Per me questa si chiama arroganza del potere. Così la riforma viene approvata e per meno di 40 magistrati noi cambiamo 7 articoli della Costituzione come se fosse un decreto legge, come se fosse il decreto Caivano". "Ci sono alcuni uffici dove manca il 40% dei dipendenti, ma intanto hanno avuto la possibilità di aprire l'inutile tribunale di Bassano del Grappa, guarda un po' in Veneto. Un tribunale che nessuno voleva, solo il ministro Nordio e il sottosegretario Ostellari e nessuno protesta soprattutto l'opposizione. Va bene a tutti". Rispetto al suo impegno in magistratura, Gratteri ha sottolineato: "Non mi fermerò finché sarò vivo, se mi sfidano non ce ne è per nessuno, io sono allenato alla guerra fin da bambino".

"Come dice un saggio detto, si può convincere solo chi è già convinto e quindi sarebbe una missione impossibile quella di convertire il procuratore Gratteri. Però a Gratteri potrei ricordare, visto che si trovano su Google o su Youtube i suoi interventi, che lui si era pronunciato a favore del sorteggio, che lui si era pronunciato contro la supremazia e la degenerazione delle correnti, che lui si era pronunciato contro la giustizia domestica del Consiglio superiore della magistratura. E quindi, semmai, non gli chiederei di cambiare idea ma gli chiederei perché hai cambiato idea". Sono invece le parole del ministro della Giustizia, Carlo Nordio, parlando a Firenze a un evento di Fratelli d'Italia sul referendum del 22 e 23 marzo, rispondendo a una domanda della giornalista Erika Pontini, caporedattrice de "La Nazione", su cosa direbbe al procuratore di Napoli per convincerlo a votare Sì alla riforma dell'ordinamento giudiziario.

Il Tempo: C'è chi può e chi non può, Gratteri può proprio tutto? Immagina se…

Scena uno. Il procuratore Nicola Gratteri si presenta in tv e legge dal suo telefonino un'intervista inesistente a Giovanni Falcone, attribuendo a quel grande magistrato cose da lui mai dette né pensate. Scena due. Il procuratore Gratteri si ripresenta in un'altra tv e, in scioltezza, qualifica come mafiosi e massoni deviati i sostenitori del Sì al referendum. La cosa è stata poco notata: ma (guarda che «cultura della giurisdizione»…), una volta presa la rincorsa, il magistrato mette nel mazzo dei cattivi per il Sì anche «gli imputati e gli indagati», cioè cittadini da considerare innocenti secondo quella Costituzione che proprio lui e i suoi colleghi brandiscono.

Scena tre. Sempre in tv il procuratore Gratteri, riferendosi ai commenti social critici nei suoi confronti, ha pronunciato parole sconcertanti: «Basta che lei vada sui social e vede le persone che scrivono sotto. (…) Ci sono persone per bene, ci sono pregiudicati, ci sono parenti di pregiudicati, c'è di tutto. (…) Ma questo è niente: poi vediamo più avanti se serve altro». Ah sì? Che vuol dire «altro»? Che facciamo (interpreto io sperando di aver capito male), organizziamo una bella indagine a carico di chi sui social osi pronunciarsi per il Sì? E infine, scena quattro. Interpellato dal quotidiano Il Foglio, dice soavemente: «Tanto, dopo il referendum con voi faremo i conti».

Purtroppo non si tratta di diaboliche manipolazioni dell'intelligenza artificiale, ma delle parole di un procuratore che può chiedere – come si sa – di privare noi cittadini della libertà. Provate a immaginare cosa sarebbe successo se la metà di queste cose le avesse dette un ministro del governo Meloni. Avremmo già manifestazioni di piazza, maratone televisive (a reti unificate), mobilitazioni antifasciste, e un paio di campioni a scelta (un grillino a caso, o un Sigfrido Ranucci, o un altro teletribuno a piacere) appesi ai lampadari come Tarzan per organizzare il contrattacco. Ma, trattandosi di Gratteri, tutti zitti. Hanno finito i giga sul telefonino e non possono twittare? O forse hanno il corso di pilates che li tiene impegnati? Chissà.

Scene One. Prosecutor Nicola Gratteri appears on TV and reads from his cellphone an nonexistent interview with Giovanni Falcone, attributing to that great magistrate things he never said or thought.

Scene Two. Prosecutor Gratteri appears on another TV and, with frankness, qualifies as mafia and Freemasons those supporting the Yes in the referendum. The thing was barely noticed: but (look what a “culture of jurisdiction”…), once he takes the plunge, the prosecutor puts “the accused and the investigated” in the deck – citizens to be considered innocent according to that Constitution that he and his colleagues brandish.

Scene Three. Always on TV, Prosecutor Gratteri, referring to the critical social media comments against him, uttered astounding words: “Just go on social media and see the people writing below. (…) There are good people, there are prejudiced people, there are relatives of prejudiced people, there is everything. (…) But this is nothing: then we see later if we need anything else.” Oh yeah? What does “anything else” mean? Do we organize a nice investigation against those who dare to speak for Yes on social media? And finally, Scene Four. Questioned by the newspaper Il Foglio, he says sweetly: “Just, after the referendum with you, we’ll count the costs.”

Unfortunately, it’s not about diabolical manipulations of artificial intelligence, but the words of a prosecutor who can – as is known – ask to deprive us citizens of our freedom. Try to imagine what would have happened if the half of these things were said by a minister of the Meloni government. We would already have square demonstrations, television marathons (on unified networks), anti-fascist mobilizations, and a couple of champions of choice (a grillino at random, or a Sigfrido Ranucci, or another teletribune at pleasure) hanging from chandeliers like Tarzan to organize the counterattack. But, since it’s Gratteri, everyone is silent. Have they run out of gigabytes on their cellphone and can’t tweet? Or perhaps they’re taking a Pilates course that keeps them busy? Who knows.

L'Unità: Referendum: perché Meloni porta voti al NO, perché Gratteri li porta al SÌ

La presidente del Consiglio ieri è intervenuta di nuovo sul referendum. Si è scagliata contro i magistrati che scarcerano troppa gente. Non si sa bene a chi si riferisse, ma conta poco. In sostanza Meloni – forse per sbaglio, forse perché non conosce bene la riforma Nordio – si è schierata dalla parte di Pm che arrestano e contro i giudici che scarcerano solo perché non trovano legittimo l’arresto. Tradotto: stiamo ben attenti a non dare ulteriore potere ai giudici liberandoli dal condizionamento dei Pm. Dobbiamo riempire le carceri, e quindi la riforma Nordio, che è garantista, è pericolosa e va affossata.
Non ci credete? Lo so, sembra uno scherzo. Ma è così. Ogni volta che interviene Meloni, o Donzelli, o Delmastro, o Bignami, ma anche Tajani, è sempre la stessa solfa: vogliamo magistrati sbirri che mettano in prigione più gente possibile (soprattutto poveri) e seguano gli ordini del governo. Linea politica che sarebbe impossibile se passasse la riforma Nordio. A riequilibrare le cose a favore del Sì è intervenuto il noto magistrato Gratteri. Con un gesto che deve aver allontanato un bel gruppetto di elettori del No, incompatibile col Pm cowboy. Cosa ha fatto Gratteri? Ha detto a un giornalista del Foglio: “Con voi del Foglio i conti li faremo dopo il voto”. Una minaccia inaudita da parte di un magistrato, anzi del Procuratore di Napoli. Difficile che il Csm possa non intervenire, sempre che si accerti che la minaccia non costituisca un reato penale. Comunque è un attacco pazzesco alla libertà di stampa. Speriamo che il fronte del No non perda tempo e allontani Gratteri, imponendogli il silenzio.

The Prime Minister intervened again regarding the referendum yesterday. She lashed out at the magistrates who release too many people. It wasn’t clear to whom she was referring, but it doesn’t matter much. Essentially, Meloni – perhaps by mistake, perhaps because she doesn’t fully understand the Nordio reform – took the side of the Public Prosecutors who arrest and against the judges who release people simply because they don’t find the arrest justified. Translated: we are very careful not to give judges more power by releasing them from the influence of the Public Prosecutors. We need to fill the prisons, and therefore the Nordio reform, which is guarantor, is dangerous and must be sunk.

Don't you believe it? I know, it seems like a joke. But it is. Every time Meloni, or Donzelli, or Delmastro, or Bignami, or even Tajani intervenes, it's always the same tune: we want magistrate “police officers” who put as many people in prison as possible (especially the poor) and follow the orders of the government. A political line that would be impossible if the Nordio reform were to pass. To rebalance things in favor of the Yes, the well-known magistrate Gratteri intervened. With a gesture that must have alienated a sizable group of No voters, incompatible with the “cowboy” Public Prosecutor. What did Gratteri do? He told a journalist from *Il Foglio*: “We’ll make the accounts with you at *Il Foglio* after the vote.” An unprecedented threat from a magistrate, indeed the Public Prosecutor of Naples. It’s difficult for the Csm (the independent judicial council) to not intervene, provided that it is ascertained that the threat does not constitute a criminal offense. However, it’s a crazy attack on freedom of the press. Hopefully, the No front won't waste time and will distance itself from Gratteri, imposing silence on him.
