All people in the United States, regardless of immigration status, have certain rights and protections under the U.S. Constitution. The ILRC’s Red Cards help people assert their rights and defend themselves in many situations, such as when ICE agents go to a home. Special thanks to our many partners who contributed translations in the various languages now available, making these red cards accessible to more individuals.
In mid-March, ICE kidnapped Merwil Gutiérrez, a 19-year old kid in New York who was pursuing an asylum case. His only "crime" was hanging out with friends at the wrong place at the wrong time. At the time, ICE agents realized he wasn't the person they were looking for. "Take him anyway." Merwil is now sitting in CECOT where he will probably live out his remaining days.
These examples will keep emerging over time, until it's undeniable that most people sent to that hell-hole were rounded up indiscriminately. Either everyone has due process, or nobody does.

Federal immigration authorities apprehended a 19-year-old in New York despite realizing he was not the intended target.
The young man, Merwil Gutiérrez, was later deported to El Salvador's notorious super prison, despite his family's insistence that he has no gang ties or criminal history.
His father, Wilmer Gutiérrez, is now searching for answers after his son was snatched by Immigration and Customs Enforcement (ICE) agents.
"The officers grabbed him and two other boys right at the entrance to our building. One said, 'No, he's not the one,' like they were looking for someone else. But the other said, 'Take him anyway,'" Wilmer told Documented, "an independent, nonprofit newsroom dedicated to reporting for immigrant communities in New York City."

Salvadoran President Nayib Bukele and US President Donald Trump called a man mistakenly deported to El Salvador a “terrorist.” They say they cannot bring him back.
"Those statements from the very men in a position to do something add to an already terrifying reality for Abrego Garcia and his family. Bukele is falsely stating that he cannot return Abrego Garcia to the United States. The Trump administration is falsely claiming that it cannot force Bukele’s hand to release Abrego Garcia. The end result is that a man sent to one of the world’s worst prisons by mistake, along with hundreds of Venezuelans also stuck there, have no clear path to getting out."

Trump said, once again, that he would like to imprison US citizens abroad if it is deemed permissible under US law. Can we please stop referring to what trump is doing as “deportations”? Deportation involves due process. The Supreme Court (not the current one, who knows how they’ll butcher it once they have the chance) established that constitutional protections (including due process) apply to everyone in the US, no matter immigration status. I am not a lawyer or constitutional scholar, but this seems pretty clear.
