Bonkers. The #DOJ under #Trump is dictating that #HarvardLawReview remove a student editor’s disciplinary record.

"Prior to Mr. Wasserman's Harvard Law School graduation, scheduled to take place on May 29, 2025, HLR must retract the disciplinary action it instituted against him," the DOJ told #Harvard in the THIRD letter, sent May 23. "Any record of his discipline must be permanently expunged."

The #HarvardLawReview is a #student-run organization that is legally #independent from the #Harvard #Law School, acc/to a statement by a Harvard Law spox….

The #school is “committed to ensuring that the programs & activities it oversees are in compliance with all applicable laws & to investigating any credibly alleged violations,” the stmnt said.

The investigation was launched amid the #Trump admin’s decision to freeze >$2B in grants & contracts w/ #HarvardUniversity, which sued in response.

The press release cited alleged statements by editors at the #HarvardLawReview in which they appeared to favor *minority* writers. In one instance, an editor allegedly voiced concern that 4 of the 5 people who wanted to reply to an article about police reform “are white men” [okay, but that is germane to the topic]. In another alleged incident, an editor suggested that an article should get expedited review because the author was a minority.

The investigation follows a report by the [#unethical (see link) & #FarRight] #WashingtonFreeBeacon concluding that race “plays a far larger role in the selection of both editors & articles” than previously acknowledged by the #HarvardLawReview. The Washington Free Beacon article was based on leaked internal documents.

The Ascendant 'Smear Wing' of the Conservative Movement

The right once inveighed against "Borking" and race-baiting. In opposing Chuck Hagel, a part of its neoconservative wing is doing both.

Allocating opportunities & recognition based on race, rather than merit, is unacceptable, the release said.
The #CivilRights offices of the Depts of #Education & #HHS are conducting investigation.

#HarvardLawReview’s article selection process appears to pick winners & losers on the basis of race, employing a spoils system in which the race of the legal scholar is as, if not more, important than the merit of the submission,” said Craig Trainor, the DOE’s acting asst secy for civil rights.

#Trump has opened an investigation into #HarvardLawReview “based on reports of race-based discrimination permeating the operations of the journal,” per an April 28 press release from the US Dept of Health & Human Services [weird].

At issue is whether the #law review’s policies for membership & article selection violate #TitleVI of the #CivilRights Act, which bans #discrimination based on #race, #color & #NationalOrigin in #education programs receiving federal #funding.
