> En cette journée internationale des TDS (#2Juin), le Parti Pirate rappelle une urgence : celle de protéger les travailleuses et travailleurs du sexe. La loi de 2016 dite « contre le système prostitutionnel » a échoué. Elle a précarisé, isolé et exposé aux violences.

> Face à cette marginalisation, nous portons un programme clair basé sur l'autonomie, la dignité et la sécurité des personnes concernées. Notre objectif ? Abolir les mesures répressives et instaurer un cadre légal et social protecteur. #PartiPirate #DroitsDesTDS

> 1. Reconnaissance et droits sociaux Nous voulons abroger la loi de 2016 et reconnaître le travail sexuel comme une activité économique légale. À la clé : un vrai statut professionnel avec accès à l'assurance maladie, la retraite, les congés et la parentalité.

> 2. Fin du faux proxénétisme et protection Il faut modifier le Code pénal. L’entraide entre TDS ou le soutien des proches doivent plus être criminalisés. En revanche, nous renforçons les sanctions contre la véritable exploitation et les abus économiques.

> 3. Sécurité et lieux autogérés Le droit de choisir/refuser ses clients et ses pratiques doit être garanti. Nous proposons d'autoriser les lieux dédiés autogérés : se regrouper collectivement pour travailler en sécurité, sans contrainte ni intermédiaire.

> 4. Accès aux soins et accompagnement Renforcement du suivi médico-social et un accompagnement réel pour les personnes souhaitant se reconvertir. La sécurité et les droits plutôt que la répression.

> Mon nom est Dr. Tlaleng Mofokeng. Je suis la Rapporteuse spéciale des Nations Unies sur le droit qu'a toute personne de jouir du meilleur état de santé physique et mentale possible.

> Les droits des travailleuses du sexe sont des droits humains. Cela inclut le droit a la santé et, plus largement, le droit à l'autonomie corporelle ainsi que le droit à la sécurté et à la dignité.

> La décriminalisation est une condition préalable nécessaire à la réalisation effective de ces droits et de nombreux autres droits humains interdépendants.

> C'est une exigence de santé publique. La décriminalisation est soutenue par les organismes des Natios Unies, y compris ONUSIDA, l'OMS, le PNUD et de nombreux experts indépendants de l'ONU. La criminalisation est incompatible avec le cadre des droits humains. Elle réduit la capacité des travailleuses du sexe à négocier, elle limite leur accès aux services de santé et elle augmente en réalité leur exposition au VIH et à de nombreuses autre IST ainsi qu'aux violences basées sur le genre. Des témoignages présentés devant la Cour européenne des droits de l'homme ont montré que la criminalisation des clients a également entraîné ce qui suit: une diminution du nombre de clients entraînant une précarité économique, une perte de pouvoir de négociation, une exposition accrue aux violences basées sur le genre, une prise de risques accrue et un plus grand isolement et des conditions de travail plus dangereuses en raisos de déplacement et de la nécessité d'agir clandestinement. En 2024, la Cour européenne des droits de l'homme a explicitement reconnu que la criminalisation constitue une ingérence dans la vie privée et l'autonomie sexuelle des travailleuses du sexe et qu'elle a des conséquences concrètes sur leur santé et leur sécurité. La Cour a rappelé que la France doit suivre cette mesure, notamment au regard de son impact et la dernière évaluation menée en 2020 s'est concentrée uniquement sur la mise en œuvre de la loi et non sur ses effects. Et depuis 10 ans, la France n'a pas évalué l'impact de la criminalisation sur les clients, sur les personnes directament concernées.

> Aujourd'hui, les travailleuses du sexe se sont organisées pour proposer des politiques publiques mieux adaptées aux réalités vécues et plus conformes aux cadres des droits humains.

> La France ne peut plus ignorer ni la voix des travailleuses du sexe, ni celle de la Cour européenne des droits de l'homme.

> Et c'est mon vœu que les droits des travailleuses du sexe soient considérés et reconnus comme des droits humains.

> Whether we love our jobs, hate them, or have mixed feelings about them, we all deserve safety and protection from harm at work.

> When it comes to sex work, however, this is often not the reality. Laws that criminalise or restrict sex work fail to protect sex workers. Instead, they place them at risk of violence, including from the police. Criminalisation also prevents sex workers from accessing labour protections, seeking sexual and reproductive health services, reporting violence without fear, and exercising their rights like any other worker.

> Sex workers know what keeps them safe. For decades, they have been calling for the decriminalisation of sex work–– a legal model that removes criminal penalties related to sex work and is a crucial step to improving working conditions and labour rights protections of sex workers.

> Sex workers are experts of their own lives. They know what keeps them safe. Listen to them. Decriminalise sex work.

> This International Sex Workers’ Day we reaffirm our commitment to sex workers’ safety, rights, and dignity.
