La reazione era scontata. Di fronte a una legge che istituisce un tribunale militare speciale per processare i palestinesi accusati di avere legami con gli attentati del 7 ottobre 2023, una risposta della comunità internazionale era inevitabile. E se gli Stati occidentali, come di consueto, non intervengono, non può valere lo stesso principio per l’Onu.
L’Alto commissario delle Nazioni Unite per i diritti umani, Volker Türk, chiede a Tel Aviv e al governo di Benjamin Netanyahu di abrogare la legge approvata dalla Knesset che istituisce il tribunale militare speciale. Per il commissario, anche se le vittime “delle atrocità commesse il 7 ottobre meritano giustizia”, questa “non può essere ottenuta attraverso processi che non rispettano gli standard internazionali”. A preoccupare è soprattutto la “pena di morte obbligatoria”, definita “spaventosa e che rischia di causare un’irreversibile errore giudiziario per i palestinesi condannati”.

In una nota dell’Alto commissario si parla anche delle serie preoccupazioni che il tribunale possa ammettere prove ottenute sotto costrizione, violando il diritto internazionale. Per Türk “la pena di morte obbligatoria è spaventosa” e “la sua applicazione ai residenti dei territori palestinesi occupati viola le garanzie di un giusto processo chiare e inequivocabili contenute nel diritto internazionale umanitario e costituirebbe quindi un crimine di guerra”.
Uno dei problemi denunciati dall’Onu è che il nuovo tribunale giudicherà esclusivamente i palestinesi e così non avrà giurisdizione sulle potenziali responsabilità penali di altre persone e nemmeno sui presunti crimini delle forze israeliani nei territori palestinesi occupati. Insomma, prosegue Türk , “questa legge istituzionalizzerà inevitabilmente una giustizia unilaterale e la discriminazione nei confronti dei palestinesi, il che non può essere nell’interesse di nessuno ed è in contrasto con il diritto internazionale dei diritti umani”.

Special Court on October 7th, UN condemns Israel: “Terrifying, a war crime”
The reaction was predictable. Faced with a law establishing a special military court to prosecute Palestinians accused of links with the October 7, 2023 attacks, a response from the international community was inevitable. And if Western states, as usual, do not intervene, the same principle does not apply to the UN.
The UN High Commissioner for Human Rights, Volker Türk, is asking Tel Aviv and the government of Benjamin Netanyahu to repeal the law approved by the Knesset establishing the special military court. For the Commissioner, even if the victims “of the atrocities committed on October 7 deserve justice,” this “cannot be obtained through trials that do not respect international standards.” What is worrying is particularly the “mandatory death penalty,” defined as “scary and which risks causing an irreversible judicial error for Palestinians convicted.”

In a statement by the High Commissioner, there are also serious concerns that the court may admit evidence obtained under duress, violating international law. For Türk, “the mandatory death penalty is scary” and “its application to residents of the occupied Palestinian territories violates the clear and unequivocal due process guarantees contained in international humanitarian law and would therefore constitute a war crime.”
One of the problems denounced by the UN is that the new court will judge exclusively Palestinians and therefore will not have jurisdiction over the potential criminal liability of other people and not even on the alleged crimes of Israeli forces in the occupied Palestinian territories. In short, Türk says, “this law will inevitably institutionalize a unilateral justice and discrimination against Palestinians, which cannot be in the interest of anyone and is contrary to the international human rights law.”
