Una sonora sconfitta per l’amministrazione Trump, una grande vittoria per Francesca Albanese. La relatrice speciale dell’Onu sulla Palestina ha visto sospese le sanzioni imposte dal governo degli Stati Uniti grazie ad un’ingiunzione preliminare di un giudice federale statunitense del District of Columbia, a Washington.
Le sanzioni, imposte nel maggio del 2025 sulla base di un ordine esecutivo del presidente Donald Trump, impedivano ad Albanese l’ingresso nel Paese e di fare operazioni bancarie.
Quella di Trump era stata una mossa volta a punire e sanzionare, tramite il Dipartimento di Stato, chiunque sostenesse la causa della Corte Penale Internazionale per crimini di guerra contro il governo israeliano. Per Albanese inoltre l’accusa era quella di aver “minacciato l’interesse nazionale e la sovranità degli Stati Uniti”, con riferimento ad un rapporto dell’inviata speciale dell’Onu che puntava il dito contro diverse aziende statunitense e al loro contributo alla distruzione della Striscia di Gaza e del popolo palestinese.
Secondo il giudice federale Richard Leon (giudice nominato dall’ex presidente George W. Bush), che ha sospeso le sanzioni, Albanese sarebbe stata punita dal Dipartimento di Stato Usa per il solo fatto di aver espresso le sue opinioni, violando così i diritti della Albanese garanti dal Primo Emendamento della Costituzione.
A presentare ricorso era stato il marito dell’inviata speciale Onu, Massimiliano Cali, agendo per conto proprio, della moglie e della loro figlia, sostenendo che le sanzioni del Dipartimento di Stato del 2025 violassero i diritti di libertà di espressione della consorte.
Nel parere motivato di 26 pagine che sospende le sanzioni, una misura temporanea in attesa della sentenza definitiva, Leon scrive che “se Albanese si fosse invece opposta all’azione della Cpi contro cittadini Usa e israeliani, non sarebbe stata inserita nell’elenco delle persone sanzionate ai sensi dell’Ordine Esecutivo 14203”.
Inoltre il giudice ha stabilito che Albanese godeva della tutela della Costituzione americana, malgrado risiedesse al di fuori del Paese, ritenendo che possedesse legami “sostanziali” con gli Usa, sufficienti a far valere i diritti garantiti dal Primo Emendamento.

A resounding defeat for the Trump administration, a great victory for Francesca Albanese. The UN Special Rapporteur on the Palestinian question has seen the sanctions imposed by the U.S. government suspended thanks to a preliminary injunction by a U.S. federal judge of the District of Columbia, in Washington.

The sanctions, imposed in May 2025 based on an executive order by President Donald Trump, prevented Albanese from entering the country and conducting banking operations.

Trump’s move was aimed at punishing and sanctioning, through the Department of State, anyone supporting the International Criminal Court’s case against the Israeli government for war crimes. For Albanese, the charge was that she had “threatened the national interest and the sovereignty of the United States,” referring to a report by the UN Special Envoy that pointed the finger at several U.S. companies and their contribution to the destruction of the Gaza Strip and the Palestinian people.

According to U.S. District Judge Richard Leon (a judge appointed by former President George W. Bush), who suspended the sanctions, Albanese was being punished by the U.S. Department of State for simply expressing her opinions, thus violating the rights of Albanese guaranteed by the First Amendment to the Constitution.

It was Massimiliano Cali, the wife of the UN Special Envoy, who filed the appeal, acting on his own behalf, along with his wife and daughter, arguing that the 2025 Department of State sanctions violated his wife’s freedom of expression rights.

In the 26-page opinion that suspends the sanctions, a temporary measure pending the final judgment, Leon writes that “if Albanese had instead opposed the ICC’s action against U.S. and Israeli citizens, she would not have been included in the list of sanctioned individuals under Executive Order 14203.”

Furthermore, the judge established that Albanese enjoyed protection under the American Constitution, despite residing outside the country, believing she possessed “substantial” ties to the U.S., sufficient to enforce the rights guaranteed by the First Amendment.

Un tribunale distrettuale degli Stati Uniti a Washington ha sospeso le sanzioni che l’amministrazione americana aveva imposto a Francesca Albanese, relatrice speciale delle Nazioni unite sui territori palestinesi. Il giudice distrettuale Richard Leon ritiene che le sanzioni potrebbero costituire una violazione dei diritti garantiti dal primo emendamento ad Albanese e ai membri della sua famiglia.
In una causa depositata a febbraio presso il tribunale distrettuale degli Stati Uniti a Washington, il marito di Albanese e il loro figlio minorenne hanno descritto il grave impatto che tali sanzioni hanno avuto sulla vita e sul lavoro della famiglia, inclusa la possibilità di accedere alla loro abitazione nella capitale federale. Secondo il dipartimento di Stato Albanese aveva condotto una “campagna di guerra politica ed economica” contro gli Stati Uniti e Israele, esortando altri Paesi “a sanzionare Israele per i presunti crimini di guerra a Gaza e diverse aziende statunitensi per essere complici di tali azioni”.

A U.S. district court in Washington has suspended sanctions imposed by the American administration on Francesca Albanese, the United Nations special rapporteur on the Palestinian territories.
