Secondo il giudice federale Richard Leon (giudice nominato dall’ex presidente George W. Bush), che ha sospeso le sanzioni, Albanese sarebbe stata punita dal Dipartimento di Stato Usa per il solo fatto di aver espresso le sue opinioni, violando così i diritti della Albanese garanti dal Primo Emendamento della Costituzione.
A presentare ricorso era stato il marito dell’inviata speciale Onu, Massimiliano Cali, agendo per conto proprio, della moglie e della loro figlia, sostenendo che le sanzioni del Dipartimento di Stato del 2025 violassero i diritti di libertà di espressione della consorte.
Nel parere motivato di 26 pagine che sospende le sanzioni, una misura temporanea in attesa della sentenza definitiva, Leon scrive che “se Albanese si fosse invece opposta all’azione della Cpi contro cittadini Usa e israeliani, non sarebbe stata inserita nell’elenco delle persone sanzionate ai sensi dell’Ordine Esecutivo 14203”.
Inoltre il giudice ha stabilito che Albanese godeva della tutela della Costituzione americana, malgrado risiedesse al di fuori del Paese, ritenendo che possedesse legami “sostanziali” con gli Usa, sufficienti a far valere i diritti garantiti dal Primo Emendamento.

I just watched an episode of Masters of Horror called Homecoming directed by Joe Dante.
Almost all of Dante's movies are political but you often need to interpret. In 2005 he had something to say about the Iraq War and George W. Bush. This time there was no subtlety involved.
Homecoming is not great. If it had been purely black humor it might have worked better but it also tries to be sentimental which falls flat. As a political statement I love it.
