That makes the Constitution somewhat like a #blockchain, doesn’t it? You can’t delete amendments; you can only pass new ones that performatively (in the philosophical sense of the word) nullify (and thus repeal) the amendment you want to remove. And the consensus protocol is a two-thirds majority in the Congress and the willingness of participating states (that is, all 50 states) to ratify it…which is why the #EqualRightsAmendment remains unpassed despite the following of these procedures.

Today in Labor History March 22, 1972: U.S. Congress sent the Equal Rights Amendment to the states for ratification. It failed. And to this day, women earn 84% of what men do. One of the exceptions is public education, where teachers’ unions have fought and won the right to collectively bargain salaries based on years of experience, not gender. The first ERA was introduced to Congress in 1923. The 1972 had wide bipartisan support, including by presidents Nixon, Ford and Carter, and seemed destined to pass. However, Phyllis Schlafly mobilized conservative women against the amendment, arguing that it would disadvantage housewives, make them eligible for the draft and cause divorcees to lose custody of their children. This killed the ERA in the 1970s. From 2017-2020, several states have ratified the ERA. However, it is uncertain whether these ratifications are legal, since they occurred after the deadlines. Schlafly went on to become a major player in the anti-abortion and anti-feminist and anti-LGBTQ rights movements.

The Legal Status of the Equal Rights Amendment

Former President Joe Biden’s statement that the Equal Rights Amendment has been ratified and should be deemed part of the Constitution is welcome and correct as to the law. But it also is likely to engender great confusion and unfortunately has no legal effect. The law is clear: It is for Congress to decide whether an amendment has been properly ratified—not the president, not the archivist, and not the courts.

So sad to hear that Cecile Richards has passed at just 67 years old. She was a fighter and a stalwart for the rights of women, just like her mom. Thankfully she lived to see a president affirm the #equalrightsamendment as the 28th Amendment.

 There's so much more going on than just the #tiktokban. Don't let that be the sole thing we focus on. Biden declared the #EqualRightsAmendment has been ratified and is the law of the land- but isn't directing the amendment to be written. Trump has said he is signing #100ExecutiveOrders tomorrow (Monday, Jan 20, 2025). #ICEraids are starting on Tuesday in Chicago. PLEASE DON'T CHECK OUT. We have so much to do.

So, now we have Schrödinger's Equal Right Amendment.

It is both approved and not approved, until the box is opened, presumably by SCOTUS after somebody files suit.
