Nuclear: In Caorso and Trino, municipalities are beating the State and reclaiming the funds owed for environmental compensation.
While landing in the Chamber of Deputies, the delegation bill on nuclear energy follows its passage to the Joint Environment and Production Activities Committees, eight municipalities hosting nuclear plants and the nuclear fuel cycle are ready to collect what is due to them for environmental compensation. This was established by the Court of Cassation, which ended a dispute that lasted fifteen years and began in 2011. At the center was a 70% cut in nuclear compensation quotas, implemented from 2004 to 2011 based on the provisions of the 2005 financial law by the then-Berlusconi government. The municipalities of Minturno (Latina), Piacenza and Caorso, Sessa Aurunca (Caserta), Ispra (Varese), Saluggia and Trino Vercellese, represented by lawyer Xavier Santiapichi of the Foro di Roma, filed a lawsuit. And they won in all three levels of court: these administrations will receive fully the environmental compensation provided for by national regulations, including the amounts deducted in previous years. How much does it amount to? Just for the Municipality of Saluggia, it is about 25 million euros.
A dispute lasting five years
The municipalities had already won on the first and second levels, respectively at the Rome Tribunal in 2016 and before the Court of Appeal in 2020. The money had already been paid after the second-instance judgment, but it was blocked due to a lawsuit filed by the Presidency of the Council of Ministers and the Cipe, Interministerial Committee for Economic Programming. The lawsuit was just rejected by the judgment of the first civil section of the Court of Cassation, according to which the resources could not be reduced by 70 percent. “We are satisfied with an important ruling: the affair finally recognized the reasons of the territories that have lived with the presence of activities linked to the nuclear for decades” commented the mayor of Saluggia, Libero Farinelli, after the publication of the judgment.
How much will the interested entities receive
The judgment does not concern only the municipalities, but all entities that were entitled to compensation and that, after the cut by the Berlusconi government, filed a lawsuit. The funds are distributed annually in proportion to the surface and the resident population. 50 percent goes to the municipalities that host the plant, 25 percent to the relevant Province and another 25 percent to the municipalities bordering the one in which the plant is located. And while for the Municipality of Saluggia, which hosts the Eurex plant and the Avogadro Deposit, it is about 25 million euros, for that of Caorso, in Piacenza province, which hosts the ‘Arturo’ plant, the quota to collect is about 26 million 340 thousand euros. For Trino Vercellese, headquarters of the Enrico Fermi plant, the total amount recognized is approximately 17 million euros. “This decision – declares Mayor Daniele Pane – represents not only a legal victory, but also the recognition of the rights of our territory and our communities.” The Province of Latina, having sued the Cipe, can now ask the State for the account. Another 17 million euros. Conversely, the Municipality of Latina, which did not file an appeal, cannot do so.
