To touch on my previous post, whether copyright should exist at all, the law should at least be written such that it promotes progress (U.S. Const. art. I, § 8, cl. 8). If the statutes are interpreted in a way by which copyright instead stifles innovation, it means the law has failed at its original purpose of serving the public interest.
