As I noted originally, there *is* a growing body of legal opinion that views the now #PresidentElect to be Constitutionally #disqualified from holding office. As might be expected, this body of opinion is now being added to: some of the opinion is as current as today where, in a YouTube discussion with Brian Tyler Cohen, former federal prosecutor Glenn Kirschner re-states his view that #Trump has been adjudicated as an insurrectionist by: i) the state of Colorado; ii) #Congress (in the second #impeachment trial); iii) the #Jan6 Committee (1). #Insurrection – & not treason – is the relevant yardstick for #14thAmendmentSectionThree

Cohen & Kirschner also discuss a Dec 26 article by Evan A. Davis & David M. Schulte (“Congress has the Power to Stop Trump from Taking Office…”) where legal scholars Davis & Schulte argue that despite the implications of Trump v. Anderson (the Colorado case in #SCOTUS), Trump is still disqualified due to legal precedent & his Electoral College votes may be objected to in Congress on that basis under the Electoral Count Act (2).

I further note that there are other mechanisms available for Congress to ‘trigger’ disqualification (or to “remove such disability”) under #AmendmentXIV (see Kaitlyn Bird, “King Trump is not Inevitable” (3), Jessica Denson’s YouTube channel (4) & bibliography of legal opinion (5)): mechanisms that also fall within SCOTUS’ determination in Trump v. Anderson.

I’m not a US citizen but I care about the country (to the point that I wrote a book about it) & this is my reading of the up-to-date (as of today) legal thinking on the left. I still think that you have an ‘out’: but that this ‘out’ is going to expire on #InaugurationDay After that, all bets are off.

I have, at this moment, every confidence that the Supreme Court of the United States is going to overrule Colorado, Maine, and any other state that attempts to cite Amendment XIV to ban Donald Trump from the ballot.

#AmendmentXIV was enacted to prevent former CSA officials from holding offices under the Constitution. These were people who served a foreign government formally engaged in a state of War with the United States.

Just had someone scold me that anyone can run for office under the US Constitution. When I pointed out that #AmendmentXIV directly contradicts that opinion, they did this weird 180 and started advocating violence against #tfg. At that point I did feel like I needed to announce I was blocking, which I generally view as a supremely obnoxious behavior.

Let it be known, fucking weirdos of the Fedi: nobody's roping me into making threats against public figures on social media or anywhere else. If I've corrected you on some bullshit you were trying to pass off as fact and that's hurt your pride, maybe just mute me or something instead.

People who willfully ignore #AmendmentXIV of the United States #Constitution generally aren't so hot on straight-up ignoring other amendments that they like
