#Palestine / Report: Israel committing war crime of forcible transfer, ethnic cleansing practices in Occupied West Bank

A new report by Yesh Din & Physicians for Human Rights Israel documents the forcible transfer of 7 Palestinian shepherding communities (+1000 people) in the occupied West Bank.

Findings indicate this constitutes a war crime under international law, achieved through systematic state policies & settler violence. The report alleges these actions amount to practices of ethnic cleansing.

The investigation highlights the cooperation between the Israeli military (#IDF) and settlers, violating international humanitarian law regarding the protection of occupied populations and creating an environment where Palestinians are forced from their land.

On Escorting and Joining Attacks (Page 55, The Military Section): "Soldiers often escort and protect settlers who attack Palestinians, do nothing to prevent or stop the violence, and with increasing frequency, join the attacks."

On Direct Cooperation and Affinity (Page 55, The Military Section): "However, there is a strong affinity between the Israeli military and Israeli settlers in the OPT, reflected in official policies, local initiatives by soldiers (some of whom are settlers themselves), and close cooperation."

On State Support (Page 51, Israeli Policy Section): "State authorities – government ministries and elected officials, the army, the Civil Administration, and the police – support and assist shepherding outposts, using a wide variety of means, in the name of common political goals."

Eyewitness Account of State Support (Page 30, Al-Mu'arrajat, Quote from Salman Ka'abneh): "...until the settler scourge descended upon us, and the army, police and Civil Administration fully support them."

On Joint Actions and Blurred Lines (Page 32, Wadi a-Seeq Section): "Soldiers and armed settlers, some in military uniforms, arrived at Wadi a-Seeq in several vehicles. They fired in the air, went into tents, beat residents, threatened them, and damaged property." and later on the same page: "Over the course of that day, soldiers and settlers detained and handcuffed three Palestinians from Wadi a-Seeq, stripped them, beat them for hours..."

Palestinian Perspective on Siding with Settlers (Page 57, The Israel Police Section, Quote from Na'im Abu ‘Eid): "When we call the police, they come with the settlers and soldiers and sit down to have coffee with them. They don't protect us. Complaints are useless. The police and the army only protect the settlers."

Human rights NGOs today called on the international community to take action NOW to prevent #Israel from forcibly transferring hundreds of thousands of Palestinians who have remained in the northern #Gaza Strip outside of the area, including by denying entry of essential humanitarian aid and fuel. The Israeli ceasefire coalition, the groups #Gisha, #BTselem, #PHRI and #YeshDin, said that there are alarming signs that the Israeli military is beginning to quietly implement the Generals’ Plan

The distinction between Israeli soldiers and settlers has become increasingly blurred in recent months, with reservists like Filant being called back into duty during the Gaza war. This has led to concerns about the impunity of settlers and their ability to act with relative freedom from accountability.

According to eyewitness accounts, Filant and his men have set up roadblocks, attacked Palestinian villagers, and prevented them from accessing their olive trees. They have also been accused of setting fire to groves and stealing money from drivers. The #IDF has been accused of standing by while the settlers carried out these attacks.

Filant's actions are not an isolated incident, but rather part of a broader pattern of settler violence against Palestinians in the occupied West Bank. The Israeli human rights organization #YeshDin has documented dozens of incidents involving Filant and other settlers.

‘I am the police, I am the army’: blacklisted settler’s rule in West Bank

Palestinians tell of self-styled warlord’s brutal reign across whole of Jabal Salman valley – and he is one of many

#WestBank / Analysis: The consequences of settler violence (Yonatan Kanonich)

Kanonich, a researcher with #YeshDin volunteers for human rights, says that
either #Israel starts properly protecting Palestinian human rights, or more countries will step in as the U.S. has done.

The occupation is not just an internal Israeli matter. For years, the Israeli law enforcement system has failed to properly deal with settler violence against Palestinians in the West Bank, with police investigations consistently finding reasons not to prosecute. Now the U.S., under President Biden, has for the first time imposed sanctions on violent Israeli settlers, doing what the Israeli government should have done long ago.

Successive Israeli governments have allowed settler impunity and violence to continue unchecked, with the current government making this almost explicit policy. By imposing consequences, Biden has exposed Israel's lies and hypocrisy on settlement expansion and violence. More countries may follow with pressure.

Israel's denial of the sanctions won't help. It must either begin prosecuting settler terrorism or face growing international isolation. While the U.S. move should not be celebrated, it offers hope of starting a snowball effect of accountability for rights abuses linked to the occupation.
