Bisher sind Inhouse-Lösungen nur zulässig, wenn das beauftragte Unternehmen mindestens 80 % seiner Tätigkeiten für die kontrollierenden öffentlichen Auftraggeber erbringt. Im neuesten #Urteil (C-692/23) verlangt der EuGH, dass diese sog. 80-%-Regel wirtschaftlich-realistisch auszulegen ist, also einschließlich der Tätigkeiten der Tochtergesellschaften.
