The decision didn’t just pick the president—it also, in installing George W. Bush, allowed him to reshape #SCOTUS. As younger lawyers, 3 of the current #GOP-appointed justices aided Bush’s Florida legal team in the run up to #BushVGore [#AmyConeyBarrett, #JohnRoberts & #BrettKavanaugh]. Another, #ClarenceThomas, was part of the decision’s majority.

In Aug, #SCOTUS used its #ShadowDocket to allow #Arizona, a key swing state, to require proof of citizenship w/ voter registration forms at the request of the #RNC.

But perhaps least known—& yet, most important—was #MooreVHarper, a 2023 ruling in which the court set the stage for the next #BushVGore scenario by holding that the justices themselves would have THE LAST SAY when it comes to questions over state-level #election rules & disputes.

With Trump ballot case, the Supreme Court faces biggest election test since Bush v. Gore

A case with the potential to disrupt Donald Trump’s drive to return to the White House is putting the Supreme Court uncomfortably at the center of the 2024 presidential campaign. The justices will hear arguments Thursday in a Colorado case about whether the former president can be kicked off the state's Republican primary ballot because of his efforts to overturn his 2020 election loss. At issue is a constitutional provision adopted after the Civil War to prevent former officeholders who “engaged in insurrection” from reclaiming power. The case is the court’s most direct involvement in a presidential election since Bush v. Gore, the decision a quarter-century ago that effectively delivered the 2000 election to Republican George W. Bush.
