It's weird, and very telling, that a SCOTUS Chief Justice feels the need to publicly justify his actions in a majority opinion. (Soon after another justice preemptively attacked a critical ProPublica report by using the WSJ as a forum.) This is NOT a normal Supreme Court!
What Roberts wrote: "It has become a disturbing feature of some recent opinions to criticize the decisions with which they disagree as going beyond the proper role of the judiciary,"
What he was thinking: "We have a majority now, and we'll bloody well go as far beyond our proper role as we want. You can't stop us, ethics and precedent be damned!"
The U.S. Supreme Court on Monday declined to hear bids by Exxon Mobil Corp <a href="https://www.reuters.com/companies/XOM.N" target="_blank">(XOM.N)</a>, Suncor Energy Inc <a href="https://www.reuters.com/companies/SU.TO" target="_blank">(SU.TO)</a>, Chevron Corp <a href="https://www.reuters.com/companies/CVX.N" target="_blank">(CVX.N)</a> and others to move lawsuits filed by state and local governments accusing the oil companies of worsening climate change out of state courts and into federal courts.
An ascendant illiberal Right is using the courts as a vehicle to dismantle pluralistic society — and democracy more generally — in service of their project to enshrine elements of fascism and Christian nationalism in our institutions.
Instead of thinking about how to steer the Court’s power back in favor of liberals, it might be time to think about ways to just restrain the Court’s influence altogether.
