Himachal News: हिमाचल प्रदेश हाईकोर्ट ने अनुबंध कर्मियों के लिए पितृत्व अवकाश को लेकर बड़ा फैसला सुनाया। न्यायाधीश संदीप शर्मा की अदालत ने कहा कि यह अवकाश हर पुरुष कर्मचारी का मौलिक अधिकार है। कोर्ट ने तकनीकी शिक्षा विभाग के उन आदेशों को रद्द कर दिया, जिनमें अनुबंध कर्मियों को यह लाभ देने से इनकार किया गया था।
कोर्ट के निर्देश और नियमों में बदलाव
अदालत ने मुख्य सचिव को आदेश दिया कि अनुबंध पर कार्यरत पुरुष कर्मचारियों के लिए पितृत्व अवकाश का प्रावधान नियमों में शामिल करें। इसके साथ ही, अतिरिक्त महाधिवक्ता को इस फैसले की जानकारी संबंधित विभाग तक पहुंचाने और दो महीने में अनुपालन रिपोर्ट दाखिल करने को कहा गया। कोर्ट ने यह भी निर्देश दिया कि याचिकाकर्ता द्वारा 31 जुलाई 2024 से 14 अगस्त 2024 तक लिए गए अवकाश को पितृत्व अवकाश माना जाए।
याचिकाकर्ता का मामला और नियम 43-ए
कोर्ट ने बताया कि बच्चे के जन्म के समय याचिकाकर्ता अनुबंध पर कार्यरत था। हालांकि, जब उसने पितृत्व अवकाश के लिए आवेदन किया, तब वह नियमित कर्मचारी बन चुका था। नियम 43-ए के अनुसार, दो से कम बच्चों वाले पुरुष सरकारी कर्मचारी को बच्चे के जन्म से 15 दिन पहले या छह महीने के भीतर 15 दिनों का पितृत्व अवकाश मिल सकता है। इस नियम का हवाला देते हुए कोर्ट ने याचिकाकर्ता के पक्ष में फैसला सुनाया।
