Meet Tania Nemer, Fired Immigration Judge Suing Trump Admin Amid Purge of Immigration Court System

Former immigration judge Tania Nemer, who was fired in February, is now suing the Trump administration, alleging that she was discriminated against despite strong performance reviews. Nemer is one of about 100 immigration judges who have been fired or reassigned since Trump took office. The system is notoriously backlogged, with more than 3 million cases pending. “I was pulled away in the middle of the hearing,” she says. Nemer filed a discrimination complaint with the Department of Justice, which officials dismissed, citing Article II of the Constitution on presidential powers. “I’ve been practicing employment law and representing federal employees for almost 30 years, and I have never seen a federal agency dismiss a complaint for this reason,” says Nemer’s attorney, James Eisenmann.

The DC Circuit Court of Appeals has 4 active justices appointed by Republicans and 7 appointed by Democrats. Yet the Republicans have dominated most of the emergency three-judge panels this year. It's numerically possible for this to happen but, as far as I can tell, improbable. Is it paranoid to wonder how random these assignments have been?

900 Department of Justice alumni have warned the U.S. Senate against appointing ex-Trump lawyer Emil Bove to the appellate court. "We are all alarmed by DOJ leadership's recent deviations from constitutional principles and institutional guardrails," the former department employees wrote, adding that Bove had "disgraced" the department. The letter, dated July 16, was signed by officials from as far back as the Kennedy administration. Tomorrow, the Republican-controlled Senate Judiciary Committee will vote on whether to advance Bove's nomination to serve on the U.S. Court of Appeals for the Circuit. He will serve a lifetime appointment if confirmed.
