The two sticking points

The dispute between the Pentagon and Anthropic is centered on two uses restrictions—prohibitions on autonomous weapons and mass surveillance.

Fully Autonomous Weapons (humans out of the loop entirely) - Anthropic has not argued that such weapons should not exist. The company offered to work with the Pentagon to improve these systems, but the Pentagon refused. Anthropic believes frontier AI systems are not reliable enough to power fully autonomous weapons and as such may put America’s warfighters and civilians at risk.

Domestic surveillance – while stating it supports the use of AI for lawful foreign intelligence and counterintelligence missions. Using AI systems for mass domestic surveillance is incompatible with democratic values and presents serious, novel risks to our fundamental civil liberties.

Rug Pull executed by DoD on Anthropic

Anthropic thought a deal with DoD could be done. DoD initially pledged not to use Anthropic’ s AI for mass domestic surveillance or for fully autonomous killing machines but DoD then qualified those pledges with “as appropriate” phrases —mandating they would be the sole judge of what “is” or “is not“ appropriate.

DoD originally threatened to invoke the Defense Production Act (DPA) to compel the company's cooperation on the theory that Anthropic’ s tech was too essential to national defense to forgo. DoD then did a rug pull and jumped to threatening and ultimately stating that a formal supply chain risk designation would be applied.

The government can't credibly find exclusion is necessary when days earlier the operating premise was that the technology was indispensable

Anthropic refuses to buckle to DoD demands for "any lawful use" contract language.

DoD’s designation of Anthropic as “a supply chain risk to national security” is political theater: it is a show of rank collusive force that will not stand once this dispute gets to the courts – and it will! Anthropic has vowed to fight the designation in court.

Both parties have acknowledged contract negotiations broke down over terms of use, not adversarial risks to DoD systems ergo the supply chain risk is a total non-starter. Further, DoD’s demands that U.S. military’s contractors and suppliers stop doing business with Anthropic is bogus. DoD "does not have the statutory authority" to restrict contractors' private commercial activity.

По его словам, для защиты демократии военным действительно нужны передовые технологии, но с чёткими ограничителями и механизмами безопасности.

Ситуация вызывает дополнительный интерес ещё и потому, что выбор #OpenAI может объясняться не только технологическими возможностями, но и большей гибкостью в вопросах регулирования #AI. В отличие от жёсткой позиции #Anthropic, компания Альтмана показала готовность к компромиссам, позволяющим #USGov формально соблюдать ограничения и одновременно сохранять доступ к передовым разработкам.

Немаловажную роль играет и фактор #SiliconValley. Ранее Альтман возглавлял #YCombinator, который традиционно связан с кругом предпринимателей, известным как #PayPalMafia.
