AGI - È morto all'età di 88 anni il magistrato Diego Marmo. Da pm ha rappresentato l'accusa nel procedimento contro il conduttore televisivo, Enzo Tortora, imputato per associazione camorristica e traffico di droga, sulla base di dichiarazioni di pentiti. Un errore giudiziario ammesso anni dopo l'assoluzione del presentatore da parte della Cassazione nel 1987, per il quale Marmo chiese scusa alla famiglia.
Il magistrato ha anche ricoperto il ruolo di procuratore a Torre Annunziata e di assessore alla Legalità del comune di Pompei. Del decesso, avvenuto domenica, si è appreso oggi. I funerali si terranno domani a Napoli.
La serie tv sul caso Tortora
Nella bellissima serie tv di Marco Bellocchio, 'Portobello', realizzata per la piattaforma HBO Max, il pubblico ministero Diego Marmo era interpretato da Fausto Russo Alesi. In un'intervista all'AGI l'attore ha spiegato uno dei motivi dell'errore giudiziario che ha travolto Tortora sottolineando una delle fragilità del sistema di allora: "Sicuramente una particolarità di quel sistema era il fatto che bastavano tre testimonianze per fare una prova, per essere una prova e questo sicuramente è qualche cosa di abbastanza inconcepibile, per fortuna adesso questa cosa non c’è più".

AGI - Magistrate Diego Marmo has died at the age of 88. As a prosecutor, he represented the accusation in the proceedings against television presenter Enzo Tortora, who was accused of camorra association and drug trafficking, based on the testimony of repentinos (informers). An judicial error was admitted years after the presenter’s acquittal by the Supreme Court in 1987, for which Marmo apologized to the family.
The magistrate also held the role of prosecutor in Torre Annunziata and assessor for Legality in the municipality of Pompeii. The death, which occurred Sunday, was learned today. Funeral services will be held tomorrow in Naples.
