Prosecutor asks Texas court to reverse governor's pardon of man who fatally shot demonstrator

A prosecutor says he is asking the Texas Court of Criminal Appeals to reverse the governor’s pardon of a former Army sergeant who was convicted of fatally shooting a Black Lives Matter demonstrator. Travis County District Attorney José Garza and the family of Garrett Foster, who was killed in July 2020, have called Republican Gov. Greg Abbott’s full pardon of Daniel Perry a mockery of the legal system. Garza said Tuesday that Abbott “put politics over justice,” and he vowed to use every option available to reverse the governor’s decision. Abbott’s office has not responded to messages seeking comment.

Whitney Mitchell, who was engaged to Foster before his death at the hands of Perry, laid out her feelings about the pardon in a statement sent to the Observer.

“I loved Garrett Foster. I thought we were going to grow old together. He was the love of my life. He still is. I am heartbroken by this lawlessness,“ she said. “With this pardon, the Governor has desecrated the life of a murdered Texan and US Air Force veteran, and impugned [the] jury’s just verdict. He has declared that Texans who hold political views that are different from his—and different from those in power—can be killed in this State with impunity.”

I'm going to be honest and say #DanielPerry is lucky I'm not #GarrettFoster's father, because there is nothing in this world that would save him from me if he wasn't in prison.
I'm fine with prison, because I believe in the social contract and don't believe in capital punishment, but if the state isn't going to honor justice, game on.

…Unsealed court records revealed that he regularly shared #racist memes & threatening content in private msgs & social media posts, including descriptions of killing protesters & *minorities*.

Perry was convicted of murder in the death of 28-year-old #GarrettFoster, who was legally armed w/ an AK-47 rifle, during a 2020 confrontation in downtown Austin at a racial justice demonstration.
