Thinking about legislative changes needed in Virginia to address the housing shortage. There needs to be a reasonable definition of “harm” to determine legal standing for zoning lawsuits. Currently any change is considered harmful and grants legal standing for a lawsuit. My current thinking is that harm must be real and residential use of one’s own legal property and increased property values should not be considered harm. #virginia #housing #VALeg #litigation #zoning #TortReform

🧵 (2/2) I tried to sue the hospital, but a 2004 #Texas #TortReform law (pushed by Gov Rick Perry and approved by TxSC Justice #GregAbbott) made it impossible.

When she passed away 9 months later, I ordered an autopsy.

The autopsy revealed SHE NEVER HAD CANCER! 🤬

I tried again to sue, this time for #WrongfulDeath, and again, Texas' #Medical #Tort #Reform law made it impossible.

To this day, no one has ever been held responsible for her death. #RIPMom

Ugh! That's even worse: Patients paying with their lives for the screw-ups of the hospital that treated them. 😵

This happened to me in 2013/2014. Hospital screwed up and cost my mother her life. #Texas' Medical #TortReform law prohibited me from suing. 🤬

@QasimRashid Don't forget Gov. #GregAbbott of Texas, where #TortReform is always popular, b/c he cashed his settlement check long ago.

TEN YEARS AGO TODAY, I had to rush my mother to the hospital just hours after her third round of #chemo.

Three days later, the hospital caused a collapsed lung. A week after that, cardiac arrest left her a vegetable (where she lingered for the next 9 months before she died of a second heart attack.)

Autopsy proved SHE NEVER HAD #CANCER. Couldn't sue b/c #Texas protects incompetent dangerous doctors from lawsuits in the name of "#TortReform". 🤬 #MissYouMom

Remembering my mother this #MothersDay who died in 2014 after being MISDIAGNOSED as having malignant #cancer in 2013.

Neglect (ignored by her PCP) resulted in pneumonia that hospitalized her. The hospital screwed up, resulting in a collapsed lung 3 days later. Further neglect resulted in a cardiac arrest 5 days after that. The collapsed lung hindered resuscitation, leaving her a vegetable until she died (cancer free) 8 months later. 🤬

Texas Medical #TortReform law made suing impossible.

I see this as an effective example for the argument against #tortreform.
