L'Unità: Ruby ter, il processo riparte da zero e ricomincia la gogna per Berlusconi (anche da morto)

Formalmente processano i vivi, per corruzione in atti giudiziari le ragazze partecipanti alle cene eleganti di Arcore, ma in sostanza si tratta di Silvio Berlusconi sotto accusa pure da morto. Uno degli avvocati della difesa Marco De Giorgio parla di “vilipendio di cadavere”. Davanti ai giudici della corte di appello di Milano va in scena l’ennesima puntata del caso Ruby perché la Cassazione accogliendo la richiesta della procura aveva annullato l’assoluzione decisa dai giudici di primo grado ordinando un nuovo processo. Molti difensori chiedono di riaprire il dibattimento, altri legali puntano sulle eccezioni di costituzionalità che potrebbe portare a mandare gli atti alla Consulta. La corte di appello deciderà il 29 giugno se sentite altri testimoni o tirare dritto. La lunghezza del dibattimento dipenderà da questo.
L’avvocato Jacopo Pensa parla di un groviglio di norme dal quale è difficile districarsi. L’avvocato Ivano Chiesa ricorda quando i giudici di primo grado invitarono le difese a rinunciare ai testimoni dichiarando inutilizzabili i verbali. “Non ci potemmo difendere e qui resta da capire se quei soldi alle ragazze sono stati dati perché Berlusconi era un generoso o un fetente che voleva corrompere. Quindi per arrivare alle verità bisogna sentire quei testimoni”. “Dopo la morte di Berlusconi ormai qui è come Garlasco. Sono i parallelismi che mi fanno le persone quando dico che devo occuparmi ancora del caso Ruby” spiega Pensa.
Karima detta Ruby è lontana dal processo. Il suo avvocato Paola Boccardi riferisce che la ragazza va in tensione tutte le volte che torna in aula la storia. “Per lei è molto difficile rifarsi una vita”. In aula c’è l’ex pm Tiziana Siciliano ora in pensione. “Sono qui per dire come va a finire. Una durata irragionevole – dice– ma non è certo colpa dei magistrati. Questa è la prova dell’inefficienza della giustizia non certo della scarsa volontà o incapacità dei magistrati”. Tiziana Siciliano nei giorni scorsi ha annunciato che si candiderà come vicesindaco in una lista civica l’anno prossimo per le elezioni a Milano.

Lawyer Jacopo Pensa speaks of a tangle of rules from which it is difficult to disentangle. Lawyer Ivano Chiesa recalls when the first-instance judges invited the defenses to relinquish witnesses, declaring the minutes inadmissible. “We couldn’t defend ourselves and here it remains to be understood if those money to the girls were given because Berlusconi was generous or a scoundrel who wanted to bribe. So to arrive at the truth, we need to hear those witnesses.” “After the death of Berlusconi, here it’s like Garlasco,” Pensa explains. “It’s the parallels that people point out when I say I still have to deal with the Ruby case.”

Karima, known as Ruby, is far from the trial. An unreasonable duration – she says – but it is certainly not the fault of the magistrates. This is proof of the inefficiency of the justice system, not the poor will or inability of the magistrates.” Tiziana Siciliano announced in recent days that she will be a candidate as vice-mayor on a civic list next year for the elections in Milan.

Witnesses of a modest style
