A motion to dismiss is a pretrial motion that says "even if everything the prosecution says is true, there is no case and nothing to put before the jury because I win as a matter of law."

These are always uphill battles.

Not so.

Under both the Sixth
Amendment’s Speedy Trial Clause and the Speedy Trial Act, the right to a timely trial is vested in the public, not just in the defendant.
