Bill Cosby in trouble, the court confirms the conviction for sexual assault. The actor must pay the victim of violence $19.25 million.

Bill Cosby suffers another legal defeat. The court rejected the actor’s, 88, request for a new trial in a civil lawsuit for sexual assault worth over $19 million.

The judge of the Los Angeles County Superior Court issued his ruling stating that Cosby did not provide sufficient evidence to support his argument that procedural irregularities would have prevented him from receiving a fair judgment. The news was reported by major US media outlets.

The Appeals Court confirmed Cosby’s conviction, stating that the $19.25 million damages awarded to his accuser, Donna Motsinger, is not “excessive.” Last March, a civil jury found that the actor had drugged and sexually assaulted the former housekeeper in 1972, after leading her to one of his performances.

The jury sided with Motsinger, now 84, ordering the substantial damages and rejecting Cosby’s defense argument, that he was a victim of “summary justice” and had always denied any assault against the woman.

The legal proceedings, initiated more than fifty years ago regarding the contested events, became possible thanks to recent legislative changes that allow victims of sexual violence, committed in the past, to pursue civil lawsuits against their perpetrators.

Let's say he does. Then that would mean #tribalism was key, and that #racism played no part in it.

And if he doesn't, are we going to bandy about terms like #intersectionalAnalysis to explain away the alleged #DUI, where specifics of the case are treated as mere pretext for discrimination?

To me, "analysis" of any kind means untangling intertwined factors to arrive at the simplest explanation. #Occam #Cosby

I precedenti giudiziari

Bill Cosby sentenced: $19 million for sexual assault

AGI - A new verdict shines a spotlight on one of the most controversial cases in American entertainment. A California court on Monday ordered Bill Cosby to pay over $19 million in damages to a woman who accused him of sexual assault.

A decision that further aggravates the actor’s position
The decision, made in civil court after three days of deliberations, further complicates the position of the 88-year-old actor, who has already been accused by dozens of women of predatory behavior.

The victim’s testimony
During the trial, held in Santa Monica, the testimony of Donna Motsinger, now 84 years old, emerged. The woman stated that she had been drugged in 1972, when Cosby allegedly poured a substance into her wine glass presented as a simple aspirin.

After losing consciousness, the woman — then a waitress — recounted waking up at home, dressed only in underwear. According to the accusation, she was aware of having been drugged and sexually assaulted.

Previous judicial rulings
The case fits into a judicial landscape already marked by previous civil convictions. In the same court – AFP recalls – in 2022, a jury ruled that Cosby had to pay $500,000 to Judy Huth, acknowledging an assault that occurred in 1975 when the girl was 16 years old.

From fame to fall
A definitive collapse for the former television icon, long nicknamed “the father of America” for his role in the series The Cosby Show, which aired between 1984 and 1992.

In 2018, the actor was incarcerated in Pennsylvania for another case of sexual assault, before being released in 2021 after the annulment of the conviction for a procedural defect.

The reason I felt compelled to comment earlier is because twice in 2 days I saw 2 posts on #BlackMastodon alleging #racism:

1. Women's value gets lower the more children they have.

2. A #rapist was prosecuted. Isn't it good that he was brought to justice?

The person in the post about #BillCosby suggested #Cosby was prosecuted because he was black, not because he raped women.

She used some big words like #intersectionalAnalysis, but nothing of substance

>> Racism is intertwined with class bias and misogyny. They do not operate independently of each other.

They do. Conflating them creates unfortunate effects, as in your example where you suggest #BillCosby was prosecuted for being #black (unlike many in the #Epstein network).

It is simpler & more accurate to say #Cosby was disciplined for predation of women, not because of his race.

Also, we do not yet know how many black people are implicated in Epstein case.
