How to read EU legislation?

Since it’s teaching eval season again, just a reminder that numerous studies have shown that these evals measure bias, not teaching effectiveness. Their use in for anything beyond feedback directly to the prof—ie tenure & promotion—is legally dubious, professionally irresponsible, and ethically wrong.

So, read yours with a glass of wine and a whole shaker of salt. Solidarity to all the women out there who get comments on being motherly or mean, well-dressed or unattractive, too challenging or a push-over.

I’m sitting next to Professor Kwoka at a transparency conference where we’re speaking later. Her research & new book on the Freedom of Information Act is a must-read on what ails the FOIA system: https://www.yalejreg.com/nc/symposium-saving-foia-00/ #OpenGov #FixFOIA #FixFOIA

Hey folks - this is a good time to decide to mess with Texas.

Texas state privacy law being debated is being called the strongest law in the country. But there’s an effort underway to strip data revealing of sexual orientation from the list of sensitive data types….

I'm afraid this paragraph from SCOTUS today (Twitter v Taamneh) is going to be cited a lot for the proposition that no one is legally responsible for decisions made by AI: "Once the platform and sorting-tool algorithms were up and running, defendants at most allegedly stood back and watched."
People have been posting glaring examples of ChatGPT’s gender bias, like arguing that attorneys can't be pregnant. So @sayashk and I tested ChatGPT on WinoBias, a standard gender bias benchmark. Both GPT-3.5 and GPT-4 are about 3 times as likely to answer incorrectly if the correct answer defies gender stereotypes — despite the benchmark dataset likely being included in the training data. https://aisnakeoil.substack.com/p/quantifying-chatgpts-gender-bias

First was an excellent discussion with @Margotkaminski on regulating #AI on the @lawfare podcast. This is not only a great summary of the current state of efforts to regulate AI, but also an incisive look into the issues with these attempts. Highly recommend https://podcasts.google.com/u/1/feed/aHR0cHM6Ly9mZWVkcy5hY2FzdC5jb20vcHVibGljL3Nob3dzLzYwNTE4YTUyZjY5YWE4MTVkMmRiYTQxYw/episode/NjQ0MDY3NGU0NTYxYjEwMDExZTM4NGU1?sa=X&ved=0CAUQkfYCahcKEwjokbHUl8H-AhUAAAAAHQAAAAAQLA (2/6) #law
The Lawfare Podcast - Margot Kaminski on Regulating AI Risks

In the last few months we've seen an explosion of new AI products, especially those built around large language models. And in response, we've also heard calls for far more aggressive government regulation. But what does it mean to regulate AI? Margot Kaminski is an Associate Professor of Law at University of Colorado Law School. She's just published a paper for Laware's ongoing Digital Social Contract research paper series, in which she argues that the emerging law of artificial intelligence is converging around risk regulation. Alan Rozenshtein, Associate Professor of Law at the University of Minnesota and Senior Editor at Lawfare, spoke with Margot about what risk regulation means in the AI context and why she thinks that it has some serious drawbacks. The Developing Law of AI Regulation: A Turn to Risk Regulation

The fast-developing law of AI appears to be… risk regulation. But there is more to risk regulation’s toolkit than impact assessments.
