There's also the strong likelihood of liability under the False Claims Act. Their contract terms with the US Government almost certainly require them to comply with NISPOM, including requirements that their key management personnel acquire and maintain security clearances and comply with all of its obligations. Elon's conduct is not compatible with those requirements, to put it mildly. Maybe there's some scenario where all SpaceX personnel are doing all their reporting and self-reporting of derogatory information as required, and maybe the government is issuing formal waivers, but the more likely situation is that they are willfully noncompliant despite claims to the US Government to the contrary.

Investors are buying all of this risk: the litigation risk with noncompliance with US Government NISPOM, the likelihood of losing their current and future contracts with the US Government, global criminal and civil liability for their production and distribution of CSAM and nonconsensual intimate images, their shaky business model across all of their lines of business, and all of it being led by an unhinged executive shackled to an increasingly unpopular political movement.

@bflipp @anildash Nasdaq changed it's rules in May to remove the long standing governors on when a company could be added to the index, and based on the new rules SpaceX can hit the index in 15 days. This will cause algorithmic buyers like index funds and ETFs to buy it automatically. Sure seems fishy that the Nasdaq changes it's rules just in front of the SpaceX/xAI, OpenAI and Anthropic IPOs. It's like there are powerful forces that want to push risk to the public so they can cash out before more people learn about the risks in these stocks.

Personally, I believe that a free market under strict collective control plus some additional measures could be the most sustainable system. As an example of the extra measures, I would remove all inheritance beyond a threshold (say, one house, and a certain amount of valuables and heirlooms); everything else goes to charity or to the state. Also, I would nationalise and guarantee all essential services, such as health care, water, electricity, schools, universities, gas for cooking and heating (before we phase it out). All else, private companies can provide it. And forbid by law lobbying and corporations financing parties and candidates. And I could go on.

Uhm, maybe I should run for office... I'm afraid I won't get a single vote, though... 😅

My (seemingly flawed) understanding was that, with indicies like S&P noping-out (and others supposely considering similar), the "force into 401(k)s thing was basically being vetoed. And, even then, the "forcing" would only occur if your portfolio included index-funds that hadn't vetoed or funds that were still specifically planning to include the new offering(s)?
