After seeing the recent #AgeVerification announcement and the capitulation from #systemd , I couldn't hold out any longer on addressing #OpenSource and #OpenStupidity.

https://github.com/systemd/systemd/issues/41202

Now, the question is whether the issue will stay up long enough to make a point or see any joiners.

I took a slightly different tact than a straightforward attack on the decision.

Post some legal orginizational information, somewhere, or create it if there is none · Issue #41202 · systemd/systemd

It's no surprise that posting a #GitHub #suggestion and request to the issue queue at #systemd concerning #AgeVerification has been removed.

Not closed. Not responded to. Just plain deleted.

There was nothing in it to trigger a 'Code of Conduct' violation or being against the posting guidelines. They want zero discussions, period, and that means no public visibility either.

I am not a fan of obliterating important topics when they're uncomfortable to read.

Posted here as a thread...

Apparently, it's been decided to prematurely capitulate rather than look forward to any consequences. I think it would be wise to address the question of legal entity(s) and identify specifically who represents systemd and its individual devs and committers. What orgs are there already in place, and what is your/their legal status?

Age verification is now and has always been - in simple non-legal terms - a "Point of Sale" issue.

To make it anything else, is to automatically open up the door to litigation. It seems that systemd has no formal and legal organization that is meant to represent the project against legal issues or to have any representation that could council anyone before leaping into this decision. If that is indeed the case, then there is unlikely to be any preexisting defense fund that is capable of taking on the legal battles that will be seeking whomever they can blame,

...

... with more demands than just money alone can quench. That would also mean that there is currently no legal representation for the project, and/or, it's developers, who can also be litigated against for any legal issue.

Meta, and their equivalents, have spent Billions of dollars to get anyone else to take the blame and shoulder the legal burden. And any entity that accepts that responsibility is falling for the lie that it is somehow legitimate and reasonable.

...

Consider that they would rather - and willingly - pay out several Billions in funds to push that narrative, than to actually prepare their own defense. Think about that reality alone, and tell yourself this was a good choice, and hopefully you see the folly. If it's determined that no one sees that as an issue, then consider the ramifications before they show up on your doorstep.

A law that does NOT take into account who is defensibly required to be the arbiter of verification, is not legal, and will be removed at the first judicial test. Unjust and indefensible laws are stricken off the books with alarming regularity, but a position of defense is abdicated the very moment you independently agree to take responsibility for a legally attackable stance.

Is anyone prepared to defend that position in cash, and take down the creative work of thousands of committers...

... to take a responsibility that is not yours or theirs to bare?

I'd suggest that you start filling up some bank accounts with millions of dollars, if not far, far more, and hire a small army of lawyers to combat any litigation. If not, I'd suggest that devs prepare to find a new flavor of another equivalent to put your time and resources into.

...

...

Having done that, it would be equally helpful to users and devs alike, that you publish the information, announce who represents you, and offers a point of contact for any/all legal issues.
