So let me get this straight: The so-called "originalists" on the Supreme Court have essentially given the U.S. president the power of monarchs. Just days before the 4th of July, mind you. The hypocrisy is staggering.
@rbreich
They want to raze the house down.
@rbreich Hypocrisy is a defining feature of fascism.

@rbreich Roberts in 2005:

"I believe that no one is above the law under our system and that includes the president. The president is fully bound by the law.”

John Roberts: 'President Is Fully Bound By The Law': VIDEO

The hypocrisy, it burns.

Comic Sands
@Pxtl @rbreich He changed his mind, and having the power to do so, changed the law as well. This is what I meant when I criticised the American legal system as ‘rule by law’, not ‘rule *of* law’.
@rbreich At Robert’s confirmation hearing he clearly stated, “No one is above the law under our system and that includes the president. The president is fully bound by the law.” Almost as if he were lying to get the job…
@bot23 @rbreich I don't suppose that any of the other people who make decisions for that court could be accused of lying, now could they?
@rbreich
Why does it seem like they always do their despicable acts around the 4th of July?
@NinjaLombax
They do despicable things year round.
@rbreich

@rbreich almost seems as though the Biden admin should put those powers he just gained to good use.

But I'm aware it's far too much when asking a Dem authority to wield power. Even if the world is burning down.

@rbreich by this courts “logic” , Biden can have dump removed as an immediate, dangerous threat to the entire world

@rbreich .. WHO is PROTECTING America against the TREASON of TRAITORS ?????

WHO ? WHO ?? WHO ???

@rbreich And all the other GOP hypocrisy for the last 35 years was what? “Concerning?”
@rbreich Are you doing everything you can to cause a change at the top of the Democratic ticket? We're sleepwalking into disaster.
@rbreich we should all be reading up on Chomsky
@rbreich hey this means biden (the current president) can do whatever he wants right? Or does that only apply to Trump?
@sushidowsingrod @rbreich SCOTUS gets the final decision on what a president can and cannot do
@mswoods @rbreich isn’t that what was decided today?

@mswoods @sushidowsingrod @rbreich

The #SCOTUSTraitors seem to think they have an unlimited god-like power of unconstrained judicial review.

#FAOA
#FuckAmericaOverAgain

@rbreich the question is: What is the man people put in the White House to fight this shit going to do for them? Oh, right, he's busy making excuses for being a terrible candidate.

#Biden #debate #DirtyTricks Could it be that Biden's poor performance at the debate ws because someone slipped him a mickey? These things happen in politics sometimes. See: https://www.sunjournal.com/2022/02/06/how-mainer-edmund-muskies-tirade-a-half-century-ago-may-have-cost-him-the-white-house/ "Muskie’s address seemed so bizarre that some of his aides thought somebody might have slipped LSD into the coffee he drank before taking the stage, former staffer Martin Walker wrote in The Guardian in 1996. A CIA officer, Miles Copeland, wrote in his 1978 memoir that some of his friends at the intelligence agency were convinced that a Nixon operative, probably one of the ex-CIA men who worked for the president’s reelection committee, slipped LSD into Muskie’s drink 'before he played that famous weeping scene.'" https://retronewser.com/2022/02/26/emocratic-presidential-favorite-edmund-muskie-appears-to-break-down-while-attacking-newspaper-publisher/ ". . . fear of Muskie’s alleged unstable emotional condition led some New Hampshire Democrats to defect to George McGovern."

They are not originalists. They are origami experts. They bend and twist the pages before them to come up with creatures entirely new and heretofore unknown.

@MartyLemert @rbreich "Give me all your money & I'll make some olrigami honey." -- Colurtney Barrett

Whol knew she was singing abolut the Supreme Court?

@rbreich Quite literally. Since all official acts are non-prosecutable, the President now has the full mantle of the Crown, err, the State, behind all their actions. Only acts of personal corruption or enrichment even cross the bar.
@rbreich so the question is what Biden will be doing about this? Is he going to use this ruling to his advantage to win reelection and restructure scotus to get rid of this/other rulings or he is going to give a 2min speech saying he dissents, do nothing and then let a convicted felon do whatever he wants post Nov? Latter is looking more like an inevitability now. When your country is facing an existential threat, do whatever is necessary to defeat it.
@rbreich They hurt themselves in their confusion. 🤦
@rbreich Well, monarchy was a normal practice in the years before adoption of the US Constitution. So resurrection of monarchy is consistent with SCOTUS new love of we-made-it-up-historical rationales

@rbreich
If I were an #Optimist, I'd say that now there is now ABSOLUTELY NO WAY DONALD T**** WILL EVER BE PRESIDENT. 👍

If #Biden wins, no worries. #democracy continues.

If #Biden loses, he now has the authority to arrest, deport, whatever #TheOrangeMenace or at the very least "refuse to step down" (send our own #FakeElectors; foster a #riot to disrupt the #certification, etc) to a #ClearAndPresentDanger like Donald T****. #TrumpVsUS #AboveTheLaw #Immune

@MugsysRapSheet @rbreich can anyone talk me through the "if Biden wins" scenario? Not necessarily questioning that everything would be fine, but what does that look like?

@nottrobin @rbreich
"If #Biden wins..."

The chances he will abuse his authority are slim to none.

There is a strong possibility the next @Potus will get as many as 3 #SCotUS picks. We've seen what a Court with just THREE T**** appointees can do to rip up the #Constitution. Imagine a Court with SIX T**** appointees! 😱

Biden with a Dem controlled #Congress will codify #Roe and he will sign it.

We've already seen what T**** was willing to do when he was still constrained by the law. Imagine.

@MugsysRapSheet @rbreich

Thanks

One thing I was thinking of was what does the path look like for undoing this ruling? Can it only be achieved by taking over the supreme court? Or can it be achieved through legislative means?

He would only need 2 picks technically to get to a 5-4 democratic court right?

@nottrobin @rbreich
Well, one of the likely #SCotUS opening is Sotomayor, so if she's one of the 3 openings, it doesn't change the balance of the court (unless she's one of three.)

That leaves Congress.

If Congress fails to be an option, that just leaves trust that #Biden won't abuse his power (as T**** most assuredly will.)

Then the problem is put on hold for 4 more years. #TrumpVsUS #Immunity Ruling

@MugsysRapSheet @rbreich HMM…I STILL DON’T KNOW WHY THIS IS NOT BEING REPORTED MORE BY THE MSM?
@rbreich
If the Supreme Court doesn’t like what a a president does, all they have to do is rule that the actions weren’t “official.” You’re saying the Supreme Court made the president into a king. It’s much worse than that. The president is above the law as long as the Supreme Court approves of his actions.
In other words: they didn’t make the president a king. They made themselves kings. How anyone who claims to care about freedom can support that is beyond me.

@rbreich Forget the hypocrisy, (hyperbolically speaking, but not really) this is the start of the Republican Coup.

Remove Trump, we still face:
- MAGA
- Project 2025
- Conservative #SCOTUSTraitors super-majority who disregard precedent

What happens when Republicans nominate someone who is savvier, more articulate, and maintains message discipline? Worse they win? Do you think the Republicans will ever relinquish power?

#FAOA
#FuckAmericaOverAgain

@rbreich if Trump wins the election he'll eventually kill those very same SC justices

@rbreich

"Few knew that when the Republican Party declared a war on culture many decades ago, they meant a war on the culture of American liberty itself.

As they now facetiously exclaim that America has always been an autocracy, and we just never noticed."
SearingTruth, A Future of the Brave - The Enemy Within, 2005

@rbreich

It is ironic that the constitution, designed to promote a democratic form of government includes a two part poison pill, the electoral collage and the unelected, lifetime tenured, above the law Supreme Court
#usconstitution #SupremeCourt #electoralcollege #irony

@rbreich Since the US Constitution says “all men are equal before the law”, the Supreme Court would need to amend the Constitution to grant immunity to the President.

@rbreich I can only dissent with my vote and voice but I too dissent. In November you choose between a President or a King. It is simply that existential. If you vote for a President you can vote them out in four years. If you vote for a King (or abstain from voting) you will never get the chance to elect another President again.

Do you protect the United States Constitution millions of Americans died to protect or do you throw away the Bill of Rights?

@rbreich I think the big issue with monarchs was an unelected leader with no term limits, not legal immunity.
