He also argued #Congress would have to pass specific #legislation authorizing states to bar candidates from the #ballot. (No. The #14thAmendment already establishes the #law)

Liberal & conservative #justices alike warned that if CO had its way in declaring #Trump ineligible, a single #state could decide for the rest of the #nation whether a presidential candidate is permitted to run. Justice Samuel #Alito said that would create an “unmanageable” situation.

@Nonilex And the argument ignores this very appeal path ('due process'!), where the Supremes get to decide this for all states: the questions of whether the 14th applies to the president, whether the wording of his oath qualifies, and precisely where the constitutional lines are drawn around the definition of insurrection. Next time - if there be one - will be much easier on the states, and quite consistent.
