OMFG THIS IS SO HUGE!!!

WHAT THIS MEANS: If a company attempts to dissuade their workers from forming a union...

THE UNION IS AUTOMATICALLY FORMED WITH OR WITHOUT A FORMAL VOTE AND THE COMPANY MUST IMMEDIATELY RECOGNIZE IT.

Jumping up and down because OMFG THIS IS BIG!!!

Companies That Try to Union-Bust Will Be Forced to Recognize Union, NLRB Says

The National Labor Relations Board just made it a whole lot harder to union-bust.

The New Republic
@JenWojcik I wondered for a moment if companies might try to manipulate this by backing a more complicit union, but "needs majority employee support" gets in the way there. I expect someone or other will test the edges of this, regardless.
@emurphy of course they will.

@JenWojcik

Terms and Conditions:

By attempting to union bust, you automatically agree to the terms of the union. 👍

@JenWojcik what this means is every workplace should form a union.
@JenWojcik As a union member, I approve this message.
@JenWojcik So... what are the odds that the courts will strike this down?
@juergen_hubert Too many variables to say.
@JenWojcik Good news but I would imagine it’s going to trigger a lot of litigation.
@JenWojcik This is a massive win for labor! Hell yes!
@JenWojcik
Great idea, could you cite the law or statutes, for blind people with addhd like me?
@ipd I have no more information than what was in the article that I linked.
@JenWojcik I hope it holds ... today's courts have a way of overturning regulations.
@JenWojcik FYI: New employee training for a major grocery chain, Wegmans Food Markets, in NY, VA, etc. includes anti-union propaganda. Just sayin’…
@iDGS @JenWojcik As a union shop steward, albeit in the UK, this is very welcome news!

@eyebee @iDGS

This is for the US. Did you read the article? Because it's pretty clear you didn't.

@JenWojcik it's only logical. You can't union buat without a union xD

@JenWojcik I love this, but approaching 30 years of union membership and activism leads me to believe that there’s something missing here.

I hope I’m wrong. Wouldn’t be the first time.

@bubbajet Honestly, I have never seen anything with so much teeth come out of NLRB. It's a bit shocking!
@JenWojcik It's always been pretty wild to me that there's been no real downside to companies trying to union bust. This finally makes it a bad idea.
@JenWojcik making it easier for a return of the Orange beast.
@JenWojcik Union-busting #Cemex (mentioned in the article) appears to be the same "controversial" company that's been accused of eroding the shoreline in #Monterey. https://www.mercurynews.com/2017/06/27/controversial-beachfront-sand-mining-operation-along-monterey-bay-to-close/
Controversial beachfront sand mining operation along Monterey Bay to close

The last coastal sand mine in the United States, a Monterey Bay plant that scientists say has caused significant erosion of beaches in the area, will close in three years under a settlement agreeme…

@JenWojcik

I hope everyone recognizes the imperative of ensuring Biden & Harris are reelected in order to keep this new rule in place. A Republican administration would move rapidly to undo it.

If we also elect a Democratic Congress there's a reasonable chance they will codify something like this in law.

Future elections will matter at least as much as the last several have, arguably more.

@JenWojcik So pleased to see people once again recognising the value of unions for the ordinary working person.
@JenWojcik this is so good heres hoping it will spread to other countries
@JenWojcik Wish I had this a decade ago when I tried to form a union and was met with the most illegal activity from corporate that the union had ever seen.
@JenWojcik This would quickly be upended should Trump get re-elected.
@JenWojcik this is amazing and exactly how it should work. The works should be able to defend their rights
@JenWojcik
As much as I want to feel happy about this, the NLRB has very little real power.
@JenWojcik That is good. I hope it is enforceable.
@JenWojcik what country/jurisdiction is this about?
@JenWojcik okay, but what does the NLRB have to enforce that? What if the company flat out screams “I don’t want to and you can’t make me?” If it’s just fines, then the policy has no teeth.
@JenWojcik @mariyadelano I’m curious how often the union-busting occurs at this stage. Mostly I hear about big companies like Walmart shutting down operations before it gets as far as a majority of workers requesting recognition.
@JenWojcik Sanity in the US of A? What's the next idea you steal from us Europeans - HEALTHCARE‽
@JenWojcik Wow, this is incredible!

@JenWojcik

Meanwhile....

"BoTh pArTiEs ArE tHe SaMe!1!1"

- some numptie on the internet who thinks they're a sophisticated political thinker

@JenWojcik This is only after a union has been recognized by a majority of employees at a workplace, right?

Can companies still union bust by scaremongering at a workplace before people sign union authorization cards?
