This Court has no philosophy other than monarchy. They respect neither existing law nor public opinion. They are willing to set aside statute, precedent, and the plain meaning of the Constitution if that’s what’s needed to further their goal of establishing a unitary and autocratic Executive.

Roberts once declared that “#Korematsu was wrong the day it was decided”. At exactly what point did he change his mind on that?

You would think at some point a court would question the factual or rational basis for his actions. Like his claim that tariffs on Canadian imports are required for national security reasons.

Trump invokes 18th century law to speed deportations, judge stalls it hours later

A federal judge barred the Trump administration Saturday from carrying out deportations under a sweeping 18th century law that the president invoked just hours earlier to speed removal of Venezuelan gang members from the United States. U.S. District Judge James E. Boasberg said he needed to issue his order immediately because the government already was flying migrants it claimed were newly deportable under Trump’s proclamation to be incarcerated in El Salvador and Honduras. Earlier, Trump claimed the Tren de Aragua gang was invading the United States and invoked the Alien Enemies Act of 1798, a sweeping wartime authority.

At its annual spring symposium on Jan. 28, the Asian American Law Journal at Berkeley Law commemorated the 40th anniversary of the coram nobis case overturning Korematsu v. United States.
