Suppose an operating system doesn't issue signals for adult lusers who aren't 'Users' as defined by AB1043 (that is, defining adult lusers to be eighteen years or older).
Further suppose that the California Attorney General issues an injunction against the OS providers as per the law text despite no 'User' being harmed.
Does the Attorney General have legal standing in court to enforce this injunction in the absence of any harmed party?
Sorting my sister’s MacBook with Fedora was a win, but it’s got me twitchy. While we celebrate #FOSS, the "Golden Cage" is closing in.
Between #AB1043 mandates and Microsoft’s "Face Check" infrastructure, a hard schism is coming: "Sanitised Linux" vs "Free Rebel" distros.

Continuing my perusal of Ageless Linux - which I still think is utterly brilliant - they have an interesting argument for not complying with the California age verification law, which is simply this:
- If the OS refuses to collect age data, no children can be identified.
- If no children are identified, no child can be affected.
- If no child is affected, the OS provider cannot be fined.
Or, more succinctly: the data you provide is exactly what the authorities will use to fine you.
They point out that the California Attorney General will likely not interpret the law so charitably, but that's the point - to make them justify this unjust law.

I cannot express how disappointed I am to see open source projects giving in to complying with age attestation laws.
I feel like complying really undermines any first amendment arguments. Software is a first amendment protected form of expression, giving in before getting any actual threats from the state makes your participation seem voluntary.
