Islam’s Teachings on Slavery, Emancipation, and Human Dignity: A Scholarly Refutation of Modern Misconceptions

The topic of slavery in Islam is among the most misrepresented subjects in modern discourse. Critics often approach the subject through the lens of post-Atlantic slavery, an economic system built on race, perpetual bondage, plantation labour, and dehumanisation. Islamic law (Shari‘ah), by contrast, dealt with an already-existing global institution and placed upon it unprecedented restrictions, regulations, and pathways to abolition. Any fair analysis must distinguish between what Islam introduced and what pre-Islamic societies practiced.

This article presents an accessible yet scholarly explanation of Islam’s actual teachings on slavery and concubinage, refutes widespread misconceptions, and clarifies the moral framework underlying these rulings.

  • The Historical Context: Islam Did Not Introduce Slavery, It Regulated and Dismantled It

  • Slavery existed in every civilisation: Greek, Roman, Persian, Indian, African, and Jewish societies all institutionalised it. When Islam emerged in the 7th century, slavery was a global norm with no ideology or religion working to reform it.

    Rather than abruptly banning an economic structure embedded across continents, which would have produced mass social collapse and human catastrophe, Islam enacted a gradual abolition through four major pathways:

    A). Closing all doors to new slavery except one: the lawful capture of enemy combatants in a legitimate, declared war.

    Random kidnapping, enslavement of civilians, debt slavery, and enslavement through raids were all categorically prohibited.

    B). Opening multiple doors for emancipation: freeing slaves became

    ○ an expiation for many sins (Qur’an 4:92; 5:89; 58:3),

    ○ among the highest acts of worship, and

    ○ an obligation upon the state treasury (Bayt al-Māl) for those unable to purchase freedom.

    C). Guaranteeing legal rights and personhood: slaves could own property, conduct business, petition a judge, marry, study, and seek freedom through mukātaba (contracted emancipation), which masters were obligated to honour.

    D). Ending the multi-generational caste system: children born to concubines became free, fully legitimate, and equal heirs—something entirely unknown to ancient societies.

    If one compares these reforms to other civilisations, Islam stands out as the only pre-modern system that made emancipation a religious duty.

  • The Islamic Moral Framework: Human Equality and Dignity

  • At the core of Islamic teaching is the principle:

    “We have honoured the children of Adam.” (Qur’an 17:70)

    Human beings possess inherent dignity, regardless of race, class, or status. The Prophet Muhammad (peace be upon him) famously declared:

    “Your servants are your brothers.” (Ṣaḥīḥ al-Bukhārī, 30)

    He commanded Muslims to:

    • feed slaves the same food they eat,
    • clothe them like themselves,
    • not call them “slave,” but “my young man / my young woman,”
    • and free them whenever possible.

    This is not the rhetoric of a faith promoting oppression. It is the rhetoric of a lawgiver setting slavery on a path toward extinction.

  • Misconception 1: “Islam allowed rape of concubines.”

  • This accusation reveals a profound ignorance of Islamic law.

    A). Sexual relations required consent under Shari‘ah

    The Qur’an forbids forced sexual violation categorically:

    “Do not compel your women to prostitution when they desire chastity.” (Qur’an 24:33)

    Classical jurists used this verse to establish a universal maxim:

    “Coercion invalidates all sexual rights.”

    The jurists were unanimous that sexual coercion is a punishable offense, regardless of whether the woman was a wife, concubine, or stranger. If a man violated a captive, he was subject to ḥadd punishment, financial compensation, and the captive became instantly free by law (istīlād bi’l-fajūr).

    B). Concubinage existed only after legal warfare

    Islam did not permit taking random women as concubines. Only women captured in a legitimate war, where both sides recognised the laws of war, could be taken into custody. This was the universal norm across civilisations.

    C). Captives had immediate protections

    • They could not be harmed, sold into prostitution, or separated from their children.
    • They could demand mukātaba (contractual freedom).
    • Any child born to them was free, and the mother became permanently protected and emancipated at the master’s death.

    Islamic concubinage was therefore nothing like the plantation, race-based, perpetual slavery of the Atlantic world.

  • Misconception 2: “Slavery in Islam was unlimited.”

  • Islam drastically narrowed the circumstances in which a person could enter bondage.

    Only one path remained: war between sovereign nations.

    Pre-Islamic Arabia had:

    • debt slavery,
    • kidnapping,
    • highway enslavement,
    • enslavement of the weak,
    • and hereditary multi-generational bondage.

    Islam abolished every one of these.

    The Prophet (peace be upon him) declared:

    “Allah has removed from you the pride of the Age of Ignorance.”

    This included the system of perpetual slavery based on lineage. Under Islamic law:

    • A slave could become a scholar, a judge, even a governor.
    • Several leading scholars of hadith were former slaves.
    • The most powerful general of the Abbasid era, Nasr al-Khuzāʿī, was born from a concubine.

    This was a transformative legal order, not an endorsement of exploitation.

  • Misconception 3: “Islam protected the institution of slavery permanently.”

  • Islam did the opposite: it established an incremental abolition strategy, centuries before Europe even discussed the idea.

    Emancipation is among the most frequent moral exhortations in the Qur’an. Islam tied the freeing of slaves to:

    • spiritual purification,
    • charity,
    • political justice,
    • and state responsibility.

    Empires that became deeply Islamic, like the Muslim West African states, are historically documented as reducing slavery far below their non-Islamic neighbours. Thus, the claim that Islam “preserves slavery” is historically and legally inaccurate.

  • Theological Wisdom: Why Didn’t Islam Ban It Overnight?

  • A sudden ban in 7th-century Arabia would have meant:

    • hundreds of thousands of displaced, starving people,
    • no welfare institutions to protect them,
    • destruction of families,
    • civil unrest,
    • and collapse of the economy.

    Islam does not legislate idealism detached from reality. It legislates mercy grounded in practicality.

    The Prophet (peace be upon him) followed the same model with wine: gradual prohibition, step by step, until society could bear the change.

    Similarly, Islam:

  • Dried up the sources of slavery,
  • Freed existing slaves gradually,
  • Provided rights and dignity during transition,
  • Made emancipation a divine virtue,
  • Set the institution on a path to disappearance.
  • This is not moral failure; it is moral excellence.

  • Why Modern Critics Misunderstand

  • There are three major reasons:

    A). Anachronism

    They project modern Western moral categories onto ancient institutions.

    B). Selective reading

    They quote a verse or hadith out of context, ignoring legal commentaries, juristic consensus, and historical realities.

    C). Confusing Islamic reform with pagan practice

    Islam did not create slavery; it reshaped it until it died out in Muslim societies.

  • Islam’s Legacy: The Most Humane Slave Code in Pre-Modern History

  • If we compare:

    • Roman slavery
    • Greek slavery
    • Persian slavery
    • European medieval slavery
    • Atlantic slavery
    • Hindu caste-based slavery

    Islam’s system stands out for:

    • recognising the slave’s full humanity,
    • obligating kind treatment,
    • forbidding mutilation, torture, or exploitation,
    • encouraging emancipation passionately,
    • and eliminating racial justifications entirely.

    It is no coincidence that the Atlantic world, built on racial slavery, feared Islam’s spread among enslaved Africans. Islam empowered them with dignity.

    Conclusion: Islam’s Teachings Cannot Be Measured by Ignorant Accusations

    Islam confronted a global institution with wisdom, restraint, and long-term reform. It did not endorse injustice; it neutralised it. It did not create slavery; it abolished every source but one and then opened dozens of doors to freedom.

    The Qur’an’s consistent message is liberation, dignity, and justice:

    “And what will make you know the uphill path? It is freeing a slave.” (Qur’an 90:12–13)

    Any honest reader must acknowledge that Islam’s approach to slavery was revolutionary for its time, and far more humane than any other civilisation. Far from being a stain, it is a testament to the prophetic mission of our beloved Master Muhammad (peace be upon him): a mission that confronted entrenched injustice with realism, mercy, and divine wisdom.

    On the Need of Unity Between Semitic Faiths

    The Holy Quran gives a call of unity and harmony to all humanity and intends to unite all humans under the banner of One God. It is called Monotheism; belief in One God. Oneness of God means oneness of mankind. The Quran asks the Holy Prophet Hazrat Muhammad (PBUH) to invite the People of Book to harmonious relations and dialogue with wisdom and decency.

    Today, the whole world stresses on the need of Interfaith relations and dialogue, but it should be noted that it was the Quranic instruction and advice to unite the believers of different faiths and maintain harmony, peace, and unity between different religions. The Truce of Medina between the Jews and the Muslims was the brain child of the Holy Prophet to maintain cordial relations between the followers of Judaism and Islam. One point of the Truce was to jointly defend the attack of outsiders. But in the Battle of Trench between the idolaters of Mecca and the Muslims of Medina, the Jews breached the truce and helped the Meccans against the Muslims. Consequently, the Muslims attacked the Jews residing in Khyber and defeated them. Some of them were killed and others banished from Medina.

    It is true that the Jews, according to the Holy Quran were a Chosen race and God showered His immense blessings on Bani Israel. But, at the same time, the Holy Quran in the Chapter “The Cow”, severely condemns the breaches of covenants, and murder of the prophets by the Tribe of Israel. The Jews of Medina are also condemned for their enmity against Muslims and Islam.

    At present, the peaceful relations between the Jews, the Christians and the Muslims in Middle East are the utmost need of the hour. Israel has exceeded all limits and is persistently persecuting the innocent citizens of Gaza in Palestine. For the last seven decades, the Palestinians are heavily suffering under the stone walls of Israeli aggression.

    The present Prime Minister of Israel Benjamin Netanyahu is a fascist and racist. He wants to win the upcoming elections and is fuelling the fire of racism and religious extremism against the Muslims of Palestine. He has announced the establishment of Greater Israel. To achieve his cherished dreams, he is using American establishment. These are the Zionists who are racists and religious fanatics. The enlightened and humanistic Jews in Israel and throughout the world are condemning the inhumane policies of Benjamin Netanyahu. They are protesting against genocide of the Civilians of Gaza.

    The people who talk about the recognition of Israel by Muslim states, must realize the hazards of recognizing Israel until Israel recognizes Palestine according to UN resolution of Two Independent States. For two years, Israel has killed one hundred thousand innocent civilians of Gaza including children and women. The former President of America, visited Israel and in a joint press conference with Benjamin Netanyahu announced to be more than a Zionist and announce full support to Israel against Palestine. Is his announcement not against the UN resolutions? When a president of USA supports Israeli aggression, then how the peace can be maintained in Middle East?

    The present president of America Donald Trump in his previous tenure also visited and announced full support to Israel. It is welcoming gesture that now President Donald Trump is mediating for a peaceful solution of this crisis. He has proposed twenty points for reconciliation. It is a healthy start but the intentions of the Prime Minister of Israel Benjamin Netanyahu are absolutely obnoxious. He can’t be trusted.

    Yesterday, in an interview, he boasted of having very positive and fruitful meetings with American President Donald Trump and regarded his visit to America very successful for the Israeli cause. When questioned about Two States Formula, he categorically denied to accept Palestine as an independent state. This announcement is a clear violation of the UN resolutions and OSLO act. As he is planning to win the upcoming elections, he is playing with the racial sentiments of the Jews. His main interest is the release of the Israeli hostages and eradication of Hamas. It seems as after achieving these two goals, he will leave no stone unturned to crush all Palestinians. As he aspires to establish Greater Israel, he will repeat the genocidal holocaust of the Palestinians.

    Israel does not honour the UN resolutions and there is no body to check the illegal activities and inhumane atrocities of Israel in Gaza, then who will stop Israel from her obnoxious acts, if Hamas is banned or eradicated? What will be the future of the Palestinians, when the presidential tenure of Donald Trump ends? What is the guarantee that the new president will protect the Palestinians from the brutality of Israel?

    When the Muslims of Bosnia Herzegovina were disarmed with a pledge of peaceful settlement, then three million Muslims were brutally killed. No one came to save them from the brutal genocide of the Serbs. Eventually, it was president of America Bill Clinton who intervened on humanitarian basis and got the war ended. It occurred after the heart wrenching genocide of the innocent civilians of Bosnia Herzegovina.

    Similarly, the American president Donald Trump has announced to mediate after the massive genocide of the innocent civilians of Gaza. We must appreciate his efforts, though it is very late as one thousand hundred people have been killed and houses, hospitals and schools destroyed. Let us hope for better times. Peace cannot be guaranteed or maintained without the enforcement of justice.

    If America and Israel are determined to disarm and finish Hamas and claim that the crisis will be resolved by peaceful means, then they have to comply with two dire conditions. First; Israel has to recognize Palestine as an independent state according to UN resolutions. Second; till that time Muslim forces of Pakistan, Turkey, Malaysia and Saudi Arabia will be stationed in Gaza. Of course, all the Arabs are the believers of Prophet Abraham (PBUH) and we pay tribute to all the prophets of Bani Israel, hence unity, peace and harmony between the followers of the Semitic faiths.

    So far as the conflict between Israel and Palestine is concerned, Israel is aggressor and Israeli racial and religious leaders have planned to establish Greater Israel. For that plan, people like Benjamin Netanyahu are committing genocide in Gaza and intend to wipe out all Muslims. Israel is aggressor and offender. Are these the Palestinians who are perpetrating atrocities on the people of Israel? These are the Israelis who are uncouth and merciless and are even shooting the children and women at random in Gaza.

    Israel is the violator of UN resolutions and needs to be harnessed and pressured to act upon UN resolutions. If Donald Trump is sincerely trying for a permanent peace in Middle East, then he will have to stop Benjamin Netanyahu from the genocide of the people of Gaza and accept the UN Security resolution, otherwise, this will be absolutely a futile effort as Israeli Zionists are determined to erase Palestine from the globe and establish Greater Israel. It is the right time for Muslims to be vigilant and unite against Israeli aggression and establish Muslim Army to protect the Muslims as well as non-Muslims who are the victims of aggression and oppression as the Quran and the Sunnah of the Prophet of Islam instruct us.

    Sayyeda Khadija Tul Kubra (RA) – A Role Model For Muslim Women

    10th Ramadan – Death Anniversary of Sayyeda Khadija (RA)

    The great Muslim lady Sayyeda Khadijah (RA) passed away on 10th Ramadan in the tenth year of Hijrah, 620 CE, at the age of 65.

    Her death was a great loss to the Prophet (PBUH). The Holy Prophet (PBUH) was grieved to the extent that he declared the year of death of Hazrat Abu Talib (RA) and Hazrat Khadija (RA) as Aam- ul-Huzn i.e. the year of mourning.

    Sayyeduna Rasulullah’s (PBUH) marriage with Sayyeda Khadija (RA) took place about fifteen years before the beginning of the Revelation, he being 25, and she was 40. She was a rich widow and ran a large trade of her own. It was she who offered herself in marriage to the Holy Prophet Muhammad (PBUH) who was associated with her in trading ventures. From the time of her marriage with the Holy Prophet till her death, over a period of twenty years, she gave her husband ease of circumstances, and deep love and devotion.

    Rasul Allah (PBUH) said: “She believed in me when none else did. She embraced Islam when people disbelieved me. And she helped and comforted me when there was none else to lend me a helping hand.”

    “Never was I jealous of any of the Prophet’s wives”, said Sayyeda Ayesha (RA) “but Khadija, although I never saw her. Her sweet memory never blurred in the Prophet’s heart. Once I hurt his feelings on this issue and he replied gravely, ‘Allah SubHanuhu wa Ta’ala has blessed me with her love.’”

    Sayyiduna Khadija (RA) bore the Beloved (PBUH) six children, the first born was named Sayyiduna Qasim (RA), after whom, according to Arab custom, the Holy Prophet (PBUH) received the Kunya “Abul Qasim” or “the father of Qasim”, then were born Sayyiduna Abdullah (RA). All of them passed away in their infancy. Amongst the daughters Sayyidah Ruqayya (RA) was the eldest, then came Sayyidah Zaynab (RA), Sayyidah Umm Kulthoom (RA) and the last and best known of them was Sayyidah Fatima (RA).

    In the absence of this Bibi’s sacrifices, Islam would not have achieved its fanfare. Hazrat Khadija was born in Makkah. She was the daughter of Khuwayled bin Asad bin Abdul Uzza bin Qusayy. Qusayy was the common progenitor of her line as well as the line of Muhammad Mustafa (PBUH) of the clan of Bani Hashim, and the future Prophet of Islam. She thus belonged to a collateral branch of the Bani Hashim.

    Next to Bani Hashim itself, her family was the noblest and the most honourable in all Arabia. Her family was distinguished not only by its opulence but also by the content of its character. Khadija’s mother had died in or around AD. 575; and Khuwayled, her father, died in or around A.D. 585. Upon his death, his children inherited his fortune, and divided it among themselves. Wealth has its own perils. It can tempt one to live a life of idleness and luxury.

    There are four women who enjoy supremacy over other women and one of the great personalities out of them is Hazrat Khadija tul Kubra (RA) on whose honour and supremacy an Ayah of Holy Quran stand witness that says:

    “We found you poor, then we made you wealthy.”

    Khadija tul Kubra (RA) was great Mohsina-e-Islam on which Quran also stands witness.

    This great woman has the honour of being the first Musaddiqa-e-Paighambar (PBUH), her wealth and sacrifices of her offspring helped Islam to a great extent as she utilised all her wealth all around to dissemination of Islam.

    Hazrat Khadija’s (R.A.) home had become a shelter not only for the Prophet (PBUH) but for all Muslims. Hazrat Khadija tul Kubra (RA) had been the protector and defender of Paigham-e-Risalat in the initial and most difficult era of Islam. The Seerat-e-Khadija is the beacon of light for women at large in every era.

    Before Islam, Khadija was the Princess of Makkah. When the sun of Islam rose above the horizon, Allah was pleased to make her the Princess of Islam also. Allah was also pleased to make her the Mother of the Believers, as He says in His Book.

    The support that Khadija gave to the Muslim community in Makkah, was indispensable for the survival of Islam. Her support to the Muslim community guaranteed its survival when it was in a state of blockade. In this sense, she was a maker of history – the history of Islam.
