Legal Arguments In Challenge To New Abortion Ban Put Off Until July 19

LINCOLN — Courtroom arguments have been delayed until July 19 in the legal challenge to Nebraska’s new law that restricts abortion and transgender health care for minors. That means that Legislative Bill 574 — which limits abortions to 12 weeks of gestation — remains in effect for now. The abortion ban was immediately effective upon the signature of Gov. Jim Pillen on May 22. The portion of the bill that bans gender-affirming surgeries for minors doesn’t go into effect until October.

It was accomplished by linking it to the bitter 2023 session’s most explosive issue — more restrictive regulation of transgender health care for minors — and softening both to keep the coalition’s 32 Republicans and one Democrat together. Gov. Jim Pillen is expected to sign Legislative Bill 574 early next week, though it’s all but certain that its strident Democratic opponents will swiftly sue and seek to block it from taking effect.

HHS Committee advanced LB574 to General File. It will ban gender affirming care for minors and punish doctors for providing this life-saving care, or even for providing a referral for care.
