According to the initial reconstructions of the officers, the incident occurred on Via Collatina in the early afternoon. The man parked his Peugeot 208 near the two schools around 2:30 PM: a time compatible, according to investigators, with the students’ exit from the “G. Gesmundo” primary school and the “Salvo D’Acquisto” middle school. The car was parked near the bus stop where a girl was waiting for the bus to return home: it was there that the 42-year-old began to masturbate inside the vehicle, staring at the young woman “persistently” and “without ever taking his eyes off her,” as stated in the order. At that point, the minor, frightened, began to scream and insult the man, who quickly left the scene.
During the interrogation, the defense of the forty-two-year-old argued that the contested behavior was misinterpreted by the minor. The man stated that he suffered from a dermatitis in the genital area, a pathology that would cause him sudden and unbearable itching. The act performed inside the car was therefore intended to find relief from the discomfort caused by the illness. A thesis that the judge of first instance described as “contradictory and unbelievable,” adding in the order that the facts are incompatible with the explanation provided by the suspect.
