L'Unità: Minore migrante prigioniero nel Cara, Italia condannata

La Corte europea dei diritti umani ha condannato l’Italia per aver violato i diritti di un minore migrante nel 2023, detenendolo per oltre 5 mesi nel Cara di Sant’Anna a Isola di Capo Rizzuto, un centro di accoglienza per adulti. I giudici della Corte hanno stabilito che così facendo le autorità italiane lo hanno sottoposto a trattamenti inumani e degradanti, perché il Cara di Sant’Anna in quel momento non aveva una zona riservata esclusivamente ai minori, che assicurava che non si mischiassero agli adulti, e inoltre non offriva alcun servizio specifico adatto ai minori.
L’Italia inoltre è stata condannata per aver detenuto il ragazzo, allora diciasettenne, contravvenendo alla legge allora in vigore che lo proibiva, per non avere informato delle ragioni per cui era trattato nel centro, e non aver agito con la necessaria prontezza quando il suo avvocato ha fatto ricorso contro la detenzione e affinché fosse spostato in una struttura adeguata. Lo spostamento del minore è avvenuto solo dopo che la Cedu, a cui l’avvocato si è poi rivolto, ha indicato a Roma che doveva essere trasferito in una struttura idonea. La Corte ha stabilito che l’Italia dovrà versare al giovane adulto, che ora vive a Lamezia Terme, 6.500 euro per danni morali e 4mila per le spese legali.

The European Court of Human Rights has condemned Italy for violating the rights of a minor migrant in 2023, detaining him for over 5 months at the Cara di Sant’Anna reception center in Isola di Capo Rizzuto, a center for adults. The judges of the Court found that by doing so, Italian authorities subjected him to inhumane and degrading treatment because the Cara di Sant’Anna at that time did not have a zone exclusively for minors, ensuring that they did not mix with adults, and furthermore, did not offer any specific services suitable for minors.

Italy was also condemned for detaining the boy, then seventeen years old, in violation of the law in force at the time that prohibited it, for not informing him of the reasons for his treatment in the center, and for not acting with the necessary promptness when his lawyer appealed against the detention and requested that he be transferred to an appropriate facility. The transfer of the minor only took place after the ECHR, to which the lawyer subsequently turned, indicated to Rome that he must be transferred to a suitable facility. The Court ruled that Italy must pay the young adult, who now lives in Lamezia Terme, 6,500 euros for moral damages and 4,000 euros for legal costs.
