Coordinating Minister for Politics, Law, and Human Rights Mohammad Mahfud MD weighs in on the death penalty sentence handed to former police Inspector General Ferdy Sambo yesterday.
Responding to media questions regarding the new Criminal Code which will replace the current one in 2026, the CM said, “It’s possible if he hasn’t been executed in three years. After ten years, if he behaves well, it can be life imprisonment. That’s the new law.”
The new Criminal Code which was passed last year does allow a reprieve for death row inmates if they’re judged to have good behavior after spending ten years in prison. The death penalty may then be commuted with life in prison instead.
Sambo is a high profile and high interest inmate, having served in the national police force as the chief of internal affairs. A position that allowed him access to some of the force’s best kept secrets and potential hot button issues.
In January, the head of Indonesia Police Watch, an independent law enforcement oversight organization, Sugeng Teguh Santoso, said that if Sambo were to receive the death penalty there’s a good chance he will spill the tea on corrupt police practices, sowing chaos to the already embattled organization.
Executions of death row inmates in Indonesia typically takes place years after the sentence was first handed down. Sambo still has an option to appeal to the High Court and then to the Supreme Court, processes that can take years. He can then still request clemency or pardon to the President to reduce his sentence if he wishes.
There’s a good chance that Sambo will remain in prison when the new Criminal Code takes effect, more than enough time for him to share his insights into internal police matters that were under his purview.

BREAKING NEWS | The panel of judges at the South Jakarta State Court has handed former police Inspector General Ferdy Sambo the death penalty for the murder of his own bodyguard, Brigadier Nofriansyah Yosua Hutabarat, in July 2022.
The State Court ordered Sambo to remain in prison until the day of the execution. The court found him guilty of taking the life of a police officer, conspiracy to commit murder, hiding and tampering with evidence, obstruction of justice, and conspiring with several other police officers to cover up the murder by pretending that there was a shootout.
The sentence was more severe than the prosecution’s demand of life in prison and the panel of judges gave no consideration to the arguments and the circumstances put forward by the defense counsel, calling them fabricated, unproven, and irrelevant to the case.
Sambo’s defense unraveled after previously hidden closed circuit television footage revealed that the shootout scenario given in the official and initial reports of the death was falsified.
For several weeks Sambo and his accomplices claimed that there was no security footage due to faulty equipment when in fact they tampered with the storage cards. Investigators found a copy of the camera footage that was not yet destroyed.
The formerly powerful chief of the internal affairs division also made up stories about being angered by Brigadier Yosua’s supposed sexual assault against his wife, Putri Candrawathi, at his home, which was supported by his driver, Kuat Ma’ruf. The judges found no evidence to the claim.
