West Virginia's SB 195 defines performing in drag or “performing while existing as transgender” to be “obscene matter or sexually explicit conduct". Performing as a drag queen or a transgender individual in a place where a minor is present is defined as a form of “indecent exposure.”

The bill also declares that “any transvestite and/or transgender exposure, performances, or display” where it might be viewed by minors violates the law’s prohibition on “obscene matter or sexually explicit conduct". This includes adults showing a minor any films, pictures, graphics, magazines, or written material that include transgender people.

Another bill, SB 194, would prohibit transgender individuals from accessing gender-affirming care until age 21.

Even if SB 195 fails to pass, harm is done. Republicans are now heading down the path of reframing trans people existing in public as obscene, and their base will follow suit with or without the bill becoming a law.

Peter Wehner wants us to believe that "Donald Trump has made the Republican Party cruel, xenophobic, exclusionary, and bigoted."

The reality is, Republicans themselves have made their party all of those things, with Trump as its face — with Trump as their face.

Republicans have, with Trump as their face, pandered to cruelty, xenophobia, bigotry, for years now. We are all reaping the whirlwind from their sowing of the wind.
