Anyone else notice this “check engine” light on the Constitution?

I think the better analogy is either EOS or deprecated.

The fact malignant actors have been able to ignore it / work round it, especially the system of a politically appointed SCOTUS with no term limits...

Probably just needs to be topped up with sufficient blood of patriots and tyrants again. That can happen when there’s a failure in regular maintenance.
