Many of you know that the administration is trying a lot of fuckery with US Passports and gender markers right now. They violated the Administrative Procedure Act by doing this without a comment period.

Right now, they are trying to cure the APA violation by having an after-the-fact comment period...

... you can go there RIGHT NOW and make your voice heard. The comments currently are overwhelmingly negative, opposing the administration's bigoted and harmful rule changes.

If you can, please go add your voice. You may think it will make no difference, but the courts can and will look at all of this. Your comment RIGHT NOW opposing passport sex marker nonsense can make you a part of yet another inevitable Trump loss in the court systems soon.

@deviantollam question around this. Does this form or site collect any PII? If so, would you not be concerned about the collection and potential harvesting from DOGE in order to effectively create a shit list of people to target?

@inari It asks someone's name and their hometown, that's all.

I'm not familiar with the legality involved but there's nothing to indicate that you have to answer honestly I suppose?

@deviantollam @Stinkie @cwg1231 I called the Regulations.gov help desk - they said that all comments have to be reviewed by the individual agency and each one has their own process (ongoing / after comment end / in batches / etc). One important thing of note was that the "DOS_FRDOC_" is a placeholder ID and will likely change at some point, so the rep said the "federal register number" (2025-02648) is what to look for.

As an old guy, I recall when "masquerade" laws were common. Supposedly to prevent criminals from hiding their faces, the reality was that the laws were used against non-cis people. Cops would travel to LGBTQ-friendly place (like Hollywood Blvd.) and round up anyone in the "wrong" clothing.

We have made progress, but now we see how fragile that really is. Fight! Pass laws!

@deviantollam for anyone commenting, it's worth noting that the U.S. State Department has been allowing folks to update their gender marker since at least November, 1980. Passports did not include a sex or gender marker until 1977. For those keeping score at home, trans people have been allowed to change the gender marker on their passport for at least 44 out of 48 years they have included such markers.

@deviantollam Consider what we know about those scanners at airports. They *can* become a "genital scan", to violate the rights of non-cis people.

I notice that the ICAO specifications specifically allow for not specifying sex, which I think is the best approach: "Where an issuing State or organization does not want to identify the sex, the filler character (<) shall be used in
this field in the MRZ and an X in this field in the VIZ."

For those struggling with what to say, I started by stating that I oppose this policy, summarizing my reasons for that position, and then justifying those reasons. It made for a long document though, so maybe just the first two are sufficient.
