Merrick Garland has bungled the January 6 insurrection case against Trump so badly that Trump’s likely not to face trial before the election, which, if he wins, will render everything moot and put the very idea of American democracy at the gravest risk it's ever faced.

But he's got the green bubbles thing covered.

@gedeonm Well, I can't go that far, as it would've swapped 5-4 to 4-5, giving Democratic appointed justices a majority for the first time since (checks notes...) 19-fucking-72. But yeah, it sure does make me wonder what Obama saw in him, and just how much of an ally to the liberals on the court he would have been.

@krisbrowne42 @gruber @gedeonm You think the SC is deliberative? Maybe in the sense of “how can I formulate an opinion that rationalizes my preconceived judgment?”. I could probably count on one hand the times any current or recent SC judge has stated something incongruous with what was reasonably predicted. In any case, the DoJ should absolutely deliberate. There’s just a desert of deliberation throughout the govt.

@gruber @gedeonm Obama (ultimately incorrectly due to turtle obstruction) saw him as a nominee that could be confirmed. Classic mistake of the Democrats ‘pre-compromise’ on everything but epic government overreach. *That* they push for and fuel the success of the GOP’s lunatic fringe in the process.
