This time I really finished.

All about about Legal Pundits and Outrage Industry, with a few cherished conspiracy theories carefully debunked.

The sections are linked and numbered.

The Misinformation-Outrage Cycle, Part 1: "There are no Yankees here!" - Teri Kanefield

This is Part 1. It’s generally best to follow the advice given to Alice and the White Rabbit in Alice’s Adventures in Wonderland: “Begin at the beginning, go on to the end, and then stop.” But if you must read out of order, here are all the links: Part 1: There are no Yankees here. […]

I’m so glad you posted that. I was just about ready to start looking for it. I started reading last weekend but got distracted!

@Teri_Kanefield
Just finished. Great read and I’m somewhat ashamed to see my own behavior.

That said, here’s my 2¢: After Al Qaeda attacked America, we imprisoned everyone involved ASAP and let them await trial in Gitmo.

#DefendantTrump’s failed coup was an exponentially greater attack on our country and IMO, there’s no rational reason trump et Al didn’t receive the same treatment. By the summer of 2021 it was pretty clear there was probable cause to arrest them.

One other point I’d like to make:

“My point is that Tribe and Luttig are not behaving the way an expert should behave. Instead of trying to educate the public about the law and how it works, they are acting like advocates.”

After seeing https://www.documentcloud.org/documents/23986911-the-sweep-and-force-of-section-iii-baude-paulsen mentioned in an article, I took a deep dive into S214A.

The Sweep and Force of Section III Baude Paulsen

@Teri_Kanefield
I spent about 40-50 hours reading about the 14A, including about two months worth of Senate debate in the congressional record, and listening to constitutional scholars and lawyers on podcasts and YouTube videos.

I’m no lawyer, but I agree with Baud, Paulsen, Amir, and Luttig, people who have spent a lifetime studying these things. I would challenge any characterization of them as Hair in Fire propagandists searching for the almighty click/dollar.

In Anderson v Colorado the #SCOTUS went directly against their “states rights” rationalization for overturning Roe v Wade, and shit all over their “strict originalist” charade.

What they did is no less than repeal a section of an amendment to the constitution without the constitutional process of passing through congress and ratification by the states.

The very eassense of “legislating from the bench” the right professes to hate so much.

@Teri_Kanefield outrage list is so cogent. The what if and constant this may happen, articles have always really annoyed me.
@Teri_Kanefield what do you have against the Yankees! They are not fascists to my way of thinking. Also they are not that hard to find. I think this Yankee thing must be a southern thing?

@Teri_Kanefield Wow Teri, that looks like amazing work. This topic makes me all woozy to think about, but it might be great reading to better understand it all.

A Comment on First Six Paragraphs: This very nearly allows the rise of a new conspiracy theory: Did the powerful enable advancement of the internet, and encourage public access to it, in order to destroy democracy? Was it not predictable that Average Joe, given unfettered access to limitless (and frequently erroneous and nefarious) input, would simply choose to affirm his own worst prejudices and misinformed theories?
