@Phreba @chris @LostReflector @clifff Love this conversation, but you guys are acting like it's some kind of company that subject to the rule of law. It's a band. Just look at the Byrds for goodness sake. They had a lineup like a rotating door, kicking people out, getting new people in at whim and for no reason. Backstabbing infighting, the whole nine yards.

Is there some kind of 'jamband kangaroo court' that's going to legislate all these hurt feelings? I don't think so.

@LostReflector @chris @aburtch @Phreba @clifff I guess you never know. I just think it’s odd they got to a point of releasing simultaneous PR statements without a settlement. And I can’t imagine a settlement was reached without provisions to prevent future lawsuits.

Then again, if the band wasn’t completely forthcoming in the settlement negotiation, I’m not sure how that affects things. That would have been quite stupid on their part. Then again, hambands gonna hamband

@chopaganda @LostReflector @chris @aburtch @Phreba @clifff The right to sue was generally lost once a settlement agreement was reached regarding the buyout and dissociation of an ownership share member of the band (presuming the rumor that the band is formed in an LLC with shares/etc). Only a misrepresentation so severe that it leads to damages/injury of Ben would allow litigation to survive past pleadings. I don’t think this meets that level if it’s only the audition lie.

@chopaganda @mattotaylor @LostReflector @chris @aburtch @Phreba @clifff with the huge caveat that we don’t know the actual legal structure of the band or the nature of the representations made. Most misrepresentations that are litigated are future contracts/values/earnings. For example, per se that Goose was in negotiations to sign a multi million dollar contract and they never told Ben’s attorney. Or they were going to sell rights to a song for big money without disclosure.
@LostReflector @aburtch @Phreba @chris @clifff The lawyers are done, everything’s been negotiated by now, and Ben signed a NDA. That’s the most likely scenario. The band is a for-profit legal entity, whether formally incorporated or not. there’s a ton of IP and copyright rights that had to be sorted, Ben owned a piece, and they paid him for it.

@Rosey @LostReflector @aburtch @chris @clifff I find this topic fascinating. Part of me sees this as what’s the big deal and then I remember that Ben’s a founding member of this band. So, I wonder what type of deal he’s negotiated. Just hope he’s getting some sort of royalty in perpetuity.
@Phreba @LostReflector @aburtch @chris @clifff I haven’t dug into how Goose handles songwriting and publishing credits, but Ben either got bought out and paid, or he’ll get his $ in the future or file a lawsuit like @LostReflector says. He’ll make good money from Goose. (Still shitty to burn him like they did.)
