A German court has just declared a "Do Not Track" #DNT signal from your browser as legally binding, pursuant to Article 21(5) #GDPR. https://www.vzbv.de/urteile/gericht-untersagt-datenschutzverstoesse-von-linkedin

@bendrath Oh, that would be such wonderful news if true. Also at a personal level. That W3C working group took more from me than I had to give,
@bendrath Wait a second, that actually happened?! It's something every even remotely privacy expert, enthusiast and whatever else in europe tolled every fucking single person complaining about cookie banners should have been in the GDPR from the start, let's hope we can get approval from a European court soon too!
@bendrath

Angel on my shoulder: what if site developers don't know about DNT headerd yet?!

Devil on my shoulder: nothing to worry about if there's no tracking done in the first place

@bendrath @TEG this will also pose a problem for the Bluesky terms of service which explicitly state that they do not consider #DNT binding

@Ruth_Mottram @bendrath No dark patterns there :) Great, and understandable ruling, with big impact.
@bendrath I only have the decision in German as a scanned PDF https://www.vzbv.de/sites/default/files/2023-10/23-10-10_Stn_vzbv_HKNRV_Gas_W%C3%A4rme_und_K%C3%A4lte_final_0.pdf Does anyone have an English version? I'm very keen to read this case. I'm also interested in asking how do we get a EDPB acknowledgement of DNT and what it means for the signal to be.
@bendrath great. That should get rid of the cookie banners. Right?
@StOnSoftware "Oh no, our cookies are totally not used to track you - they are used to enhance your user experience! Here, want a couple thousand?"
@bendrath @johanbove This is huge. Exactly as it should be. Now time to implement this across the EU and for #Safari to reimplement DNT.
@bendrath how do I activate #DNT in Firefox on Android?
@bendrath Hasn’t DNT been deprecated by browsers for years now?
How do I turn on the Do Not Track feature? | Firefox Help

This article describes the “Do Not Track” feature in Firefox 134 and below, that lets you tell websites not to track your browsing behavior.

@bendrath If you then want to implement it, you get this warning in the Mozilla web docs:

This feature is no longer recommended. Though some browsers might still support it, it may have already been removed from the relevant web standards, may be in the process of being dropped, or may only be kept for compatibility purposes. Avoid using it, and update existing code if possible;

https://developer.mozilla.org/en-US/docs/Web/HTTP/Headers/DNT

DNT - HTTP | MDN

The HTTP DNT (Do Not Track) request header indicates the user's tracking preference. It lets users indicate whether they would prefer privacy rather than personalized content.

MDN Web Docs

@t_var_s @bendrath it's being dropped because a certain browser vendor has a vested interest in it not being supported.

It's not a technically hard thing to add another header to a request.

@bendrath so what, now I sue every website I visit that shows me the *do you want coolies* plate? Nice. On it! ;)
@bendrath Wow, that’s really nice! I hope that ruling gets confirmed.
@bendrath @rogersm …and now please all over Europe!
