Unsurprised that the conservative majorty on this Supreme Court struck down affirmative action. I'm Anti-surprised, in fact. They'll likely do the same thing to student debt relief, later today or tomorrow.

It'll take about 3 years to see the full effects of today's decision across the higher education landscape; these justices won't care then, either.

If you want real remedies for centuries of inequity, inequality, and injustice, this court isn't where you need to go.

Hit the ballot box, the city council chambers, or the streets, instead.

What a sad mess.

Gonna try to stay offline for a while today.

Before I go, though, Justice Ketanji Brown Jackson's dissent in today's affirmative action decision starts on page 209, here:
https://www.supremecourt.gov/opinions/22pdf/20-1199_hgdj.pdf

And you should really read it.

When i say 3 years i mean three years. That's the time it will take for for a large enough proportion of current undergrads and grads to matriculate out and the inherent systemic and personal prejudicial biases about race and gender to even more strongly reassert themselves in a clear way in admissions numbers throughout undergraduate, graduate, post graduate programs.

The effects on students' and faculty members' mental and emotional health will be immediate and ongoing, but the details of the extent of systemic picture is only going to be fully visible in about three years.

@Wolven Thanks for the pointer. For Californians, p. 209 is... symbolic! In any case, I want to read her opinion first. (I work this morning and the reading comes later today.)

And let's expect Sandra Day O'Connor's cutesy 2003 opinion to be misinterpreted profusely and often for a few days. I need to reread that one. It rankled at the time.

From earlier decisions—Bush v. Gore (2000) comes to mind—I recommend that folks actually "get around to" reading today's decision and all the opinions.

@Wolven
Useful trick, add #page=209 to the end of the URL makes it jump automatically there:
https://www.supremecourt.gov/opinions/22pdf/20-1199_hgdj.pdf#page=209
like so. You can edit your post to add that in, and thanks for giving this information!
@ncweaver i don't have edit functionality, and i am genuinely not in the headspace. Have a good day.
@Wolven That dissent was a great read. I hope it will be used tear down the majority's decision in the near future.
@Wolven
“Ignoring race will not equalize a society that is racially unequal. What was true in the 1860s, and again in 1954, is true today. Equality requires acknowledgment of inequality.” Justice Sotomayor

@Wolven I love her writing. I hope I'm never on the wrong side of her pen.

This dissent should be required reading for everyone.

@Wolven it’s devastating - and clearly lays out how wrong the majority opinion is.
@Wolven *super mega ultra hugs* I am going to distract myself by trying to write some so I wont be screaming. Gonna scream into my manuscripts. Take care of yourself. *bonus hugs*

@Wolven

That said, it's time to pack the court with Millennial liberals, if we can't impeach and remove all the justices who lied to Congress.

@aka_quant_noir yeah, just gotta agitate for it and then vote in the people who'll actually do it, first.
@Wolven Republicans will never try to fix it. Poor, uneducated whites are their voter base. They don't want to help them be better educated or more well off financially because polling numbers show that better education and socioeconomic status will lead to those people being Democrats. And that's their base. They will certainly not try to help people outside their base.
@Wolven The shatters of the Trump era will continue to fall for decades, destroying the social fabric of the country. And all this was the wish of "Conservatives" - their dogma that "Whites (and Asians) were more intelligent" to see majority-white in higher education. It's pure racism hidden in "freedom" and "no discrimination" - toxic and destroying the society. And still nearly half of the voters would again vote for this. I'll not be in party mood this weekend.

@Wolven I really need to look into this affirmative action ruling to get an opinion on it... Obviously it **sounds** like a good thing, as affirmative action was never a good way to solve the very real racism problem we have. But my fear is that better solution arent going to replace it so it still leaves a gapping problem.

Striking down the loan forgiveness stuff makes sense, we should have always been giving free education to future generations, but forcing loan company's to pay other peoples bills for an otherwise legitimate agreement, no thats just wrong.

@freemo disagree. Good day.

@Wolven

Disagreement is always welcome, your opinion is noted and appreciated. Thanks for sharing.

You too have a wonderful day.

@freemo @Wolven just wrote what I had on my mind, they want to nullify the student loans and debts, but who’ll pay for it? and what freaks me out that if you disagree with this - you’re “racist, fascist, far right supporter” etc…

@freemo Affirmative action has its problems, but especially for higher education, it does far more good than harm.

Plus, remember, the prestige colleges already have a reverse-affirmative-action system in place called "legacies". There really ought to be a counter-balance.

@LouisIngenthron If you give advantages based on poverty, not race, you solve both issues...

On the one hand so long as racism exists and minorities disadvantaged they will be a larger portion of the group in poverty and thus would get helped.

Since its based on poverty then it isnt explicitly racial in nature so address the racism concerns.

@freemo The problem with that is that proving poverty is much more onerous than proving race. That adds paperwork hurdles that have to be jumped, usually not by the applicant themselves, but by their guardians. This phenomenon is responsible for some of the poorest families in our country failing to qualify for free student lunches for their kids.

Given that no system is perfect, requiring representation equal to the demographics of the overall population in our most critical institutions seems to be the best step forward we can reasonably expect at this time.

But also, on the other side of the equation, even the population of rich kid students shouldn't be homogenously white... it should apply to all, not just the scholarship crowd.

@Wolven Hopefully Biden will stuff that court with new appointments and this sh*t will at least slow down?
@666k9s @Wolven Biden has stated several times that he doesn’t believe in expanding the Supreme Court.
@alwillis @Wolven Really? Didn't know that. Guess we'll have to live with corruption and injustice, and a theocracy. 😠
@Wolven 3 years? 🆘🌎 Are you paying attention? 🆘🌎🔥 No action in 🌎. Not much time left. 3 years is a stretch. 🆘🌎🚫🤡🤮
@humansriseup going to need you to either watch how you speak to and what you assume about me me, or not come here at all. Good day.
@Wolven Have you read this part of it, which makes it “clear” that they can still judge essays about race? I have completely no idea how they expect universities to be able to do what they’re asking. https://twitter.com/fordm/status/1674422982394142727?s=46&t=L5aNvICKdmyBSwlIGtDXOA

@Wolven

I am strongly in favor of replacing affirmative action, with a bill, for creating in whole and in part, the economies of the slave states several. As they collectively have not been paid.

Even conservatives understand bills and theft.

Black people AS A CLASS built every feild, never paid, grew every crop, never paid, still not paid.
\
FAR MORE MONEY than mere affirmative action.

Draw up the bill for creating and building, the Southern US agricultural sector and resulting economy.
