Das war ein ausgezeichneter Vortrag von Lena #Herbst von der @tubraunschweig zur #UN-#Cybercrime-Konvention. Beim #BIGS-PizzaSeminar ist sie auf den Verlauf der Verhandlungen, die Positionen und Konfliktlinien, die Einbindung nichtstaatlicher Akteure, den erreichten Konventionstext und die anstehende Implementierung der Konvention eingegangen. Dabei hat sie auch ganz aktuell von der Sitzung des “Ad Hoc Committee to prepare the draft text of the rules of procedure for the Conference of the States Parties to the UN Convention against Cybercrime” am 26-30 Jänner in Wien berichtet.

Nun ist es an der @Bundesregierung zu entscheiden, ob und wie sie die Konvention unterzeichnen möchte. Und der @bundestag muss entscheiden, ob er die Konvention ratifizieren will.

The UN General Assembly is set to vote on the proposed UN Convention Against Cybercrime this month. The treaty is opposed by many human rights and civil liberties organizations. But @AnjaPJakobi and Lena Herbst argue in a new @PRIF paper that an acceptance with a declaration of reservations would still be the best way forward.
"Without internal critics, the ‘Conference of Parties’ (CoP), tasked with reviewing and implementing the convention, could develop additional measures and worsen a convention that at least includes some human rights safeguards. [...] If reviews of the treaty show that its implementation means compromising human rights and data protection, states should continuously reevaluate whether to stay or leave the treaty, with the Budapest Convention as a remaining fallback option."

Between a Rock and a Hard Place: The UN Cybercrime Convention - PRIF BLOG

In December 2024, UN members will vote on a worldwide Cybercrime Convention negotiated since 2019. While the convention is problematic, this Spotlight shows why a conditional acceptance nonetheless seems the best way forward. For this purpose, we first present the different meanings of cybercrime and outline the existing regulatory framework. We then examine the UN negotiations and the possible human rights implications of the convention, showing that it reflects the contestation of human rights norms and a growing division in the UN, yet supporting the convention at this point also enables long-term influence on its implementation.

Ratifying an international treaty: Is it enough? (Shortcomings of the ratification of the Budapest Convention by Greece) - International Cybersecurity Law Review

Greece ratified the Budapest Convention through Law 4411/2016. Unfortunately, the ratification of the Convention by Greece is not without shortcomings, as specified in this paper, the purpose of which is: (a) To illustrate the fact that a state may as well ratify or accede to an international treaty like the Budapest Convention but nonetheless not reap therefrom all the benefits it could have. (b) To prove that even in monist states like Greece the language barrier can be decisive in applying an international treaty. (c) To demonstrate that even in monist states the ratification of international treaties containing criminal law provisions is not enough to ensure the correct incorporation of these provisions into domestic law. (d) To showcase the reasons behind the failure of states like Greece to fully benefit from ratifying or acceding to an international treaty and what can be done to avoid similar shortcomings in the future.
