Blueskyが生み出した、世界一奇妙で意味不明な「拘束力ある仲裁条項」
@GarretSidzaka Yes, #BindingArbitration is a way that companies escape having to defend themselves in court against their customers. If you agree, you can’t use the courts. If you disagree, you decimate the numbers needed to perform class actions.
Binding Arbitration should be outlawed. Denying people access to courts should be illegal.
Playstation 5 just updated their Terms Of Use for me, and those fuckers added a #BindingArbitration clause. To opt out, I had to mail in a physical letter, which I did.
Anyway, the new terms of service is here: https://www.playstation.com/en-us/legal/terms-of-service/ and the instructions for opting out are in section 14.3.
#BankOfAmerica has sent an email informing account holders that they are adding a #BindingArbitration clause to their agreement. You have 60 days to opt out. Opting out was easy: I clicked a link, and clicked Submit.
If you are a Bank of America account holder, take a moment to check your email and click the opt-out link.
Edit: @androcat rightly says you can get phished by clicking email links. The link I got was https://bankofamerica.com/arbitration-optout - go there directly instead.
It was a freebie, and it's decently powerful. 🫢
I think after I gave up trying to resist blasted #BindingArbitration agreements, I got kinda lazy.
Also, I have some decent mitigations on my #Android phone against spywareish apps, now. 🤷♂️
Tangential: I've all but given up on dodging the blasted #BindingArbitration notices.
Even "privacy-conscious" services like @ente and @phreeli have them!
For fork's sake!!!
> sure sue them.
I wonder what percentage of employers now require ruddy #BindingArbitration clauses in their contracts now.
I used to do everything to avoid those.
Now they're basically completely unavoidable.
I was coming very close to switching to Rossmann/Merrill's new #privacy-focused #cellular carrier, #Phreeli, but it has a #BindingArbitration clause, too.
* Long, soul-rattling sigh
So, I guess I'll just switch to #MintMobile instead and pay half as much.
¯\_(ツ)_/¯

Disney thinks streaming service arbitration clause removes liability for Epcot patron's death 🤦
